they aren't technically lying. They just read off the screen in front of them. They don't have VJ stats in front of them and they can't comment on other cases anyway. If you look at the USCIS processing times, it says is small print AS OF "date" its usually 2 months or so before the processing date they are stating. I used to add 2 months to the date they "claim" they are working on. That was a bit more realistic. Even still, you can't really make a prediction. They process however they want. They pick up whatever box is closest. Don't take it personally.

Well, CIS sent me a letter telling me that they believe that my marriage was NOT entered into in good faith.....

I TAKE THAT VERY PERSONALLY!

A lot of people get RFE in this process include me.

My guess is that they ramdomly pick certain people for quality control or training new uscis officer.

If you think u have all the evidences u had submitted. Then try to have someone write letters for you guys and write a cover letter.

Because when u mail back ur RFE, there will be another officer reviewing ur package and he/she will compare

your original package and ur RFE package. I know waiting is making u stress but be patience.

The RFE states that if the additional evidence is not approved, then a denial letter will be sent and she will enter into "removal procedures".

It really smells like the pile of evidence submitted the first time got lost on the floor somewhere, that's why they asked for stuff in a generic way. Usually RFEs at this level (ROC) will ask for a few things, or a specific thing - when instead it's generic, well, they've lost what you sent in (IMO).

So, you've resent it - a set of humans will meticulously route it to the adjudicator's desk, and it'll get reviewed.

IMO, the only other pull you can get will be with an immigration liason staffer at a congressman's office - you ready to pull that trigger?

I already pulled it.......I have received a response from both my congressman's office and my senator's office. They told me to contact them again as soon as a decision has been made.

Yeah, I probably am over reacting, but I am gearing up to challenge the government should they submit a denial notice.

i would say one more reachout to that ILS human,

writing a request letter

for the ILS human to contact the congressional liason staffer within USCIS,

and inquire:

Was the evidence packet (100 pages) with the casefile, the first time, when the adjudicator opened the casefile? Yes or No? I ask this, as the wording in the RFE smacks of the evidence being lost during transit to the adjudicator's desk.

Nope, it was not packed with 100 or more pages. It was direct and to the point evidence.

If we get an interview at our local CIS office, then I'm sure we would be fine because we already info passed with them and they thought our package looked good.

They are suppose to give advice on additional info to send for the RFE, but the only thing they could recommend was wait and file taxes again to send a new joint filing.

ok - i listed 'monthly statements' earlier and you mentioned you did not send those (or did not have them) .

I did send monthly statements of what we had, but those statements don't cover the entire 2 year period because we did not have them.

Our joint car loan covers the last 12 months since we bought the car 12 months before applying.

We provided joint banking statements from the time she arrived until the time of application.

And yes, I did send the RFE cover sheet, and I have 3 complete packages with RFE cover sheet copies....1 package if we get interview, 1 package for my congressman's office, and 1 package for my senator's office.

How long after you send the RFE is a decision made, because the lady at the CIS helpline said it may take up to 4 more months.

By that time she will be starting her application for citizenship....

Quote...." You have not established that the marriage upon which you were granted was entered into in good faith. You provided some evidence of marital bona fides. However, the documentation you submitted is insufficient because it does not show financial responsibility throughout the length of the c onditional residency. Further, neither W-2's for you nor your spouse was submitted, therefore, the tax returns are incomplete. To establish eligibility for removal of conditional status, please submit additional documentation. Documentation should reflect your name and your petitioning spouse's name. In addition, the documentation should cover the period of time from the date of marriage either to the present, or to the date that the marriage was terminated through divorce, separation, or death. Please do not resubmit documentation that has already been submitted.

what's the contents of the cover letter that you wrote ?

I did not include a cover letter......It is not a requirement. I put all documents in a manila folder titled " I-751 response to RFE ".

" case number"

" name of applicant "

I assembled all document in order of their request.

I have filed 3 previous petitions and have never submitted a cover letter at anytime throughout the processes......and never had a problem before.

Visa journey is the only place where cover letters are talked about.....no government entity refers to submitting a cover letter.
