I really don't understand why are you so pessimistic.

We also just mailed RFE package. And I see they got it. I never knew they can deny people without interview.

I know it can take long time to get the respond after mailing RFE back to them.

Just check other people timelines in the monthly threads. You'll have a clue how long people are waiting after submitting RFE. And you'll notice nobody got denial, but some got interview.

I am pessimistic because RFE's for ROC is very rare.

And I personally know people who sent less evidence than us who received approval.

We have nothing further to provide for the RFE......so why would they approve us?

You definitely didn't check monthly threads. Please take a look. You'll see you are not the only one, but one of many in the same situation. May alone got huge amount of RFE 's. I haven't noticed any other month with so many rfe's.

ROC VSC mailed 5/7/14

NOA1 5/9

Check cashed 5/14

Biometrics current

RFE dated 12/18

RFE mailed 1/20

Approved 2/2 ! ( letter came from the local office)

Card received 2/17/15 !!!!

What was the RFE for? They are not necessarily rare for ROC.

You sent your RFE back on Jan 15th, that was only 3 weeks ago.

You filed in Sept, did you receive your 1 year extension letter for your wife's gc? If so, what's the fuss? You still have about 8 months to go.

My wife's ROC took 6 months last year with no RFE, you're not even there yet. Time to relax a bit.

.....and the USCIS agents at our local office could not recommend to us anything else to send.

How will they approve the application without FE?

....and don't you understand they already attempted to adjudicate her application without success

While the agents at our local office told us that our evidence package looked outstanding......it even went to the supervisor for further advise.

You may want to re-read you very first post.

So, we called CIS last night to see about our RFE.......She blatantly lied to me to get me to stop asking questions.

I can clearly see that they are processing and approving cases that were filed in October, (we filed in early September).

The lady kept telling me that they are just now processing cases filed in May 2014.....LIE, LIE, LIE.

If they are only filing case from May, then why did we receive an RFE since we filed in September...???

...because even they can't understand what the service center wants from us...

So, what is your question...???

How can the same evidence package be approved after RFE...???

Applicants with less evidence have been approved....

Sounds like you should've hired a lawyer.

An immigration lawyer can not provide us with more evidence

We filed in September and my Filipina fiancee already has her K-1 visa in her hand and will travel to the US in one week. This is the case for many Filipinas so I wonder why they told you that information that is clearly incorrect. Whats specific item was requested in the RFE?

Sorry, but my wife does not need a visa.....she is a lawful permanent resident....We have been married for more than 3 years.

RFE's for ROC are REALLY common. It happens very frequently on this forum alone. Also you would get an interview if they aren't satisfied. The only time you'd get a straight denial is if you didn't respond to the RFE.

That's wierd....because I have been looking at immigration time lines for ROC out of the Cali service center and they have all been being approved on cue at between 3 1/2 to 4 months.....

....anyway thank you for the assurance that we would be granted an interview.....because we already attended an infopass appointment at our local CIS office and they said our evidence package looked healthy and well behaved.

Take a breath!

Ask yourself if they are still working on some May folks. Are they done with May OR are they still working on May applications? What makes you think they run FIFO? DO you your really think they have a single pile that they work 1-n by date or is it more likely that they divvy them up and some folks are faster or slower then others with differing backlogs?

Just maybe while you were expecting a lie, you found what you were looking for.

Being that you are from the Philippines, I believe that you automatically get expedited. Therefore you would be process well before the date of regular cases that they are processing.

for ROC ? Really? I'd not heard that. I-130 and I-129F petitions, sure, but for ROC?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.
