I have a greencard (DV2012), I just got a job offer in California. The want me to start in 3 months.

However, my fiancee (we are not married) has no visa and our daughter got a greencard through me.

Problem is we are happy to get married so I can sponsor her for a greencard but then we will have to wait (almost 2 years at present time) for the entire process.

She has a good professional experience. However no mean for her to be sent to the US for a job at her present company, and H1B would require a job offer that she does not have yet, and would be difficult to have in the next weeks, before I accept my job offer.

Now we see 2 options, either B2 (but we know it might be difficult if not impossible) or E2, however we don't see as a real option, now, as it would mean to move in the US, take care of our little one, new school, etc... and on top of that create or run a business. ESTA could be possible but not feasible as she could stay 90 days max, but only twice a year...

The only thing we want, is to move, accept the job in the US only if we can move only the 3 of us in a reasonable time frame.

What would be our best option?

Your only option is to get married, file for green card in F2A and wait. Major mistake you haven't married before getting GC through DV - she would get it with you.

Hi,

Unfortunately, you will have to endure years of separation if you wish to immigrate to the U.S.

Get marry. File for a spousal visa after you come to the U.S. Use the VWP to visit. (If she is turned down for any visa, she will lose her ability to use the VWP.)

Many people here endure this separation. Many without being able to visit. You may not feel fortunate, but you are in a much better place than many people here.

hello there! I think everyone in a 1st place tried to avoid this visa in the end that the only option that s why we re all here today.... it took me 7 years personnaly to do this visa because i did not want TO be separte for this much time finally i am doing because that s the only way to leave with my familly happy !!!

How many times you think she will be able to use the VWP (ESTA) during a year before being asked why she spends so much time in the US? 2 times?

I just want to find the best visa for her to join us in the US while we wait for her greencard....

If your fiancé is visa waiver available applying for a tourist visa can be a killer, if they deny she will also have to update her esta and probably wont be able to use that for quite some time. They biggest thing is NEVER lie to an immigration official. Her problem will be on entry and if they ask about family here , they will be quite apt to turn her around for obvious immigrant intent

This will not be over quickly. You will not enjoy this.

I am still in the same position, I have a job offer in the US, we are not married, and I would have to start in 3 months!!! I don t know what solution I have except that we would have to wait close to 2 years of separation (with children!)... and if that s the case, then I will not accept the job unfortunately!
