Hi everyone,

Recently we got a Request for Initial Evidence (I-485) for my Adjustment of Status. We have a co-sponsor and we sent to uscis my wife's and Co-sponsor Affidavit of support so right now they are asking us for the following evidence:

1. "The petitioner/sponsor on Form I-864, Affidavit of Support, must submit a complete Federal income tax return submitted to the Internal Revenue Service(IRS) for the most recent year." My question is if we just have to send my wife's tax return for this year that we filed this month or if we have to send both, my wife's and co-sponsor's ?

I appreciate any help.

They are asking for the USC petitioner's. Did you not send the petitioner's most recent tax transcript to begin with?

If she did not file taxes and had none to send, then she needed to include a statement as to why she was not legally required to file. If she has now filed her 2014 taxes, then send a complete copy of that return which includes all forms, attachments, schedules, W-2s and/or 1099s. If she did not file for any or all of the previous 3 years, then also include the statement as to why she was not legally required to file any of the 3 years she did not.

you can go to the IRS website & print all the tax returns you need for free immediately (after creating a username/password). I believe all you need is the SSN & DOB of the person
