Hello!

I have been trying to get to the bottom of this question but I am getting mixed information and was wondering if someone could share their experience and help put our minds at ease?

I am the beneficiary and my fiancée is currently completing the i-134 affidavit of support forms and gathering the supporting documents. My questions is, do we need to supply previous year tax returns from the IRS?

My fiancée has been a student the past 3 years so her tax returns are minimal. After graduating she is now has a job as a teacher (since August 2014) earning way above the minimum required salary

We already have:

- letter from her employer

- past 4 pay stubs

- bank statement showing salary deposits.

Is this enough or do we need tax returns aswell?

Any help would be greatly appreciated!

So does this mean I don't need to provide tax return at the interview? Just the documents I have?

We will be submitting pay stubs for the last 5 months, tax transcript for last years taxes, current letter from employer stating annual salary and job status and I-134. This should be more than enough. When you file AOS you will need to submit tax transcripts or tax returns. All previous years will need to have been filed if she hasn't filed them. That is stated on the I-864 form. Good luck!

I'm sending my fiance to his interview on Wednesday with the i-134, a letter from my employer (stating my title, annual salary, etc.) and pay stubs from the last 6 months (as I started a new job in August as well). My fiance doesn't have a copy of my tax transcripts as my current employer letter/paystubs are stronger (meaning I make more) than at my previous employer. So I sent him with the strongest information, if that makes sense. Will let you know how it works out lol

Yeah, I thought about sending them back with him when he was here two weeks ago, but I just wasn't comfortable sending him with a weaker transcript. And I've read on here that London only usually asks for one proof with the i-134 and that they really like recent employment letters. My fiance is also taking copies of bank statements showing his savings accounts as well for more proof that he won't be a charge on the US government, just in case, as he as some healthy savings. I'm not too worried about the tax transcript since my current income is well over the poverty line. Fingers crossed! Will keep you posted and good luck with your interview!

I have copies of my tax transcripts from my accountant (which I did not send home with my fiance for the interview) but you can order them from the IRS:

This is the link to create an account on-line. Instructions are on there as to what information you need to provide to confirm your identity before you gain access to your transcripts. It's fairly easy and quicker than requesting for them to mail you the transcripts. :)

The london embassy only requires one piece of evidence to back up the affidavit of support :)

November 1st 2014: I-129f submitted for K1 visa

February 24th 2015: Visa in hand!

February 26th 2015: POE at Las Vegas airport, then onwards to Oregon! 

March 6th 2015: Marriage (with a "real" wedding to follow next year on 7/6/2016)

March 9th 2015: AOS, EAD & AP submitted

September 22nd 2015: Interview

January 14th 2016: Two year Green card received -phew!

August 8th 2017: 90 day window begins! ROC time!

September 28th 2017: Biometric Appointment in Portland, OR

March 5th 2018: Case received by local office

August 18th 2018: 18 month extension letter mailed

December 2018: Case moved to another office

February 2019: I was emailed that I was approved and my card was in production the same day of my N400 interview 😂

London has approved many K1 cases without a tax return or transcript.

It is an easy document to get and use as proof. It is easier than bothering the boss for a letter. But they will NOT turn you away for not having a tax return as long as you can prove income.

Bank statements showing salary deposits are weak. That doesn't even show your gross income before taxes were withheld. Pay stubs a are a better choice of the two.

London will not approve a CR1 spouse visa without a tax transcript (or signed statement why sponsor was not required to file taxes) because that is written into the very detailed law about the I-864 Affidavit of Support documentation.

I have a copy of her W2, a letter from bank showing stuff, a letter from her employer stating her position etc, and 6 paystubs, my only fear is the paystubs arent sequential. anyone see me having any issues?

* - 3rd November - NOA 2 Received
