Timeline

Hello all, my wife has been here now coming up on 2 years and we recently just went back the phils. to get her sons passport. My question is how hard is the process of bringing her 12 y.o. son to the U.S., from what I read it's pretty much just sending in a I-130 form, but does anyone have experience with this that might be able to shed a little light on the situation. Thank you in advance.

For the mother to petition the child i'm assuming she is a permanent resident , She will need the following :

1. Form I-130 http://www.uscis.gov/i-130

2. A copy of green card both back and front

3. A copy of child’s birth certificate issued by civil authorities

It will be more or less 2 years to get him there , use the time wisely.

I did not say he can't , he is asking for his wife i'm answering his main question

Your LPR wife can file a petition to her 12 year old son and it will be under F2A Category. Approximately 2 years his Priority Date to be current. But if you are a US Citizen you can also petition for your step son and there is no need for a waiting period for immediate relatives of USC( your step son 12 year old is consider your immediate relative)

You wait for USCIS to approve the i130. Once approved, the case will be forwarded to NVC where you will pay the AOS and IV fees and submit the Corresponding AOS and IV packages. After NVC reviews the packages for completion, they will give the interview schedule and forwards the case to the US Embassy in Manila.

The entire process, from i130 to visa issuance may take more or less a year if you as the US citizen step-parent filed the petition. If its your LPR wife, it will take 2 years.

I didn't say you were wrong. I was just adding info that may be important. In my understanding, he is asking how easy it is to petition a minor child , regardless if its her wife or him as the USC husband. The easy way is for the USC to file I-130 for his stepchild, takes less time than when it is his LPR wife.

Oh and here the link you provided has nothing to do with I-130 , it's for NVC stage whereas OP is seeking for some help regarding sending I-130.

The link is very much needed with the I-130 process. I am not sure why you are saying it has nothing to do...the mere sending of the I-130 at the applicaion process with the USCIS is easy...things get complicated or should I say, the I-130 at the NVC stage is when it gets tricky, reason why I told the OP to be familiar with the process.

We applied recently for I-130 for our minor children ( my USC huband did instead of me ), reason why I know the process. And The link I provided hassomething to do with the I-130 which was very much helpful for us and I am quite sure it will be for the OP too.
