HI my name is Ivan Soria and here is my bulleted story:

  • We are both 22 and still in college
  • We plan to marry this summer before the next quarter begins
  • She is here in a student visa from Vietnam,
  • Do we need to do anything extra besides find a court date and pay the regular marriage fees?
  • After marriage what should our next steps be?
  • about how long on average does it take to get a green card?

Any answers would be much appreciated.

Go down to court with both Birth-certs and ID get the license

Go back get married (take some photos)

Send in I 130 (U don't have to wait for any period) make sure form

is correctly fille out with copies of both birth-cert, your ID,marriage-cert

and Check for $420.

Add her name to lease, co-mingle some funds (bank acct & Ins poliey)

no one knows for a fact how long your journey will be but it should not

be very long, if theres no past immigration or crime issues

As we are College students still and neither of us are particularly well off, we don't plan on have a huge ceremony. In fact, we plan on getting married by a county clerk, Will this present an issue?

Edit: Some more info, she has been in America for over 3 years. Does this speed anything up?

The manner in which you get married doesn't really matter, as long as you provide proof of a standing relationship and an official marriage certificate. You may however, require a sponsor if you do not meet the poverty guidelines standard. You will also want to file the I-485 (Adjustment of Status) and I-765 (Work permit) when you file the I-130. The I-485 will be the document to adjust her status to a conditional resident. This affords her a temporary green card and the ability to remove conditions two years later. Once the conditions are removed, she will receive a 10 year green card (lawful permanent resident). After she has been in the United States living as a permanent resident for 5 years, she can go for citizenship if she wishes.

For a timeline.. the I-485 takes about 6 months to a year to process (under normal conditions). I am not sure about an I-130 filed with it, and the I-765 takes 3 to 6 months. This has to be renewed to keep valid. The next steps after that for 10 year green card and citizenship I mentioned above. Everyone's journey is different though. Depending on your backgrounds, criminal and/or relationship history, etc.. it may take longer.

As far as I know her time in the U.S. does not count for anything, not under an F-1 student status. The only immigration ways for her under an F-1 are family-based, employment-based or asylum/lottery.

Okay you need to be a bit clearer.

You're posting in a k1 forum which is a fiancé visa which takes usually 5-10 months. Which means a summer wedding will not happen if you've not yet sent the petition off.

But you say she's herr on a student visa? So she's already in the states with you, what is your plan?

To apply for a k1 in which she will have to eventually go back to her country to do the medical and interview as these cannot be done in the states, or to marry and try to adjust status straight away?

You have no timeline so we have no information as to what you are actually trying to do.

What more do you need? We are both currently in California. We went to the same school for a while then I transferred and this year she plans to transfer to school near me. The plan is to get married in the summer when we have free time. Edited by IvanS

Are you applying for a K1? No? Then this is not the forum for you.

From the little information I have you are getting married this summer to someone who is in the states on a student visa.

You just need the AOS forums.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
