From my personal experience, each petition and petitioner/beneficiary case is based on its merits. Each case is different. I don't know specifically about your case or country, but there is an appeal process available for a visa denial. Sorry, but your questions begs..., why are you concerned about the potential for your case/petition being denied?

well its just scary, i keep reading so many things and i am already stressed out..i just dont want anything to go wrong, im sure you guys can understand

question, this has not happend and hopefully it will not, praying it will not, but what if they dny your visa at the embassy, what happens? do you start the process all over again?

I understand and I know how you feel... If you have a real relationship and you have sent the proof for it then you're good to go. You have done all that you can, now its up to them to decide. Our interview is actually next week, and we have nothing left but hope for the best :)

If the visa is denied it is either a 221g and more evidence is sent to the embassy or the petition is sent back to the USCIS who will send you a letter, notice of intent to revoke (or deny) and give you the opportunity to send more evidence. What evidence may depend on why the embassy denied you. Then they make a decision and either you have to file again orit's sent back to the embassy for a second interview.

So basically its just a delay for more evidence, but not an actual denial where you start from the beginning??

no. It's more complicated than that but msy not be a start over either.

As long as it's a genuine marriage and a continuous, bona fide relationship, AND backed up by supporting documents. I'm no expert, but if the beneficiary is not otherwise deemed ineligible for a US visa, s\he is unlikely to be eventually denied.

Well I found myself back on the website and I can tell you about ONE scenario, at our interview last August my wife's case was approved but my stepdaughters case was denied and I was given a 221g, after waiting 2 years 8 months and three days, we made a difficult decision but my wife and biological daughter came home with me and our stepdaughter went to live with her grandmother while we worked on the 221g.

The same day of the interview I spoke to an attorney in Honduras, an attorney whom I had worked with several times in the past and is capable - we estimated it shouldn't be that long, well working on the documents needed getting sworn statements and apostille stamps etc etc- months were going by now.

Another difficult decision was made but an inevitable decision that my wife and daughter return to Honduras to be with our oldest daughter - we sad NO MORE Than 6 months, well 6 months came and they left to go back to Honduras, the same week that they left, the attorney finally told me he has exhausted all efforts and can not get me what I need- THE SAME day I got that email from him I went BACK to my Congressman's office - I had been there once before more than a year ago, and I updated him on my situation and we have come up with a NEW PLAN-- so I am still working on that DREADED 221g.

the bright side is I am gaining all sorts of knowledge and experience in this process, and hearing different stories one thing is for certain- EACH CASE IS AS UNIQUE as a fingerprint and all you can do is prepare and do your best. fortunately an attorney in Honduras is not as expensive as one in the USA, but application fees and traveling expenses that would not be necessary if we didn't have any delays are growing-- it is an expensive adventure - and the more delays the more expensive for me anyway.....

first post in a while- I have TIME on my hands again now that I am not spending time with my family- Our three year old was in preschool for 6 months, she was acclimating very well in the USA learning English and doing great- I can only hope and pray that we are just weeks away from a resolution as my congressman said....

My situation is unique so it should not SCARE you.
