hi everyone

I moved to the USA with a k-1 visa and ended up getting my greencard, but me and my husband divorced and I just recently moved back to my home country in Canada. Ive been in Canada now since the end of this past Sept so about 6 months now. I dont plan on going back to the usa as in living or even visiting anytime soon at all. What am I supposed to do with my greencard now? I thought immigration told me before I left the usa that I was supposed to book an appointment within 6months with the consulate here in canada and have some kind of interview to abandon my greencard.

However when I tried contacting the consulate here about it they just breifly said come in personally between 8am-12pm mon-fri

thats all they said

am II not supposed to make an appointment to go in?

Is it even required to abandon your greencard>? I dont drive and the consulate is hours away from me and I really dont want to even go hahaha

If the conditions were already removed and you have a period of time before it expires, why abandon it? You never know what might changes between now and the expiration date - a great job offer, a new love (fat chance? LOL)... After all the money involved and going through the process, I'd say keep it until it expires.

It's probably a good idea to formally abandon the green card. If at some point in the future you get a job in the US or want to move for some other reason, you might find yourself in an awkward situation... you wouldn't be able to apply for a work visa or a green card because you already have a green card, but at the same time, you may be denied entry on that green card because it will have been effectively abandoned due to your absence. Even visits to the US may become problematic. As a Canadian, you can visit the US whenever you want, but if you have a green card that has "lapsed" then you may be asked about it every time you visit.

I don't know about the appointment system at your consulate, but i do know someone who abandoned his green card at a US consulate and it was a pretty straight-forward process. That person has since applied for a visit visa (he is not from a visa-waiver country) and has visited the US.

Don't forget the obligation to file US taxes.

Furthermore, she can't keep it if she claims Canadian residency on her Canadian tax return.
