What document do we need to allow my fiancee's sons(age 3 and 6) to come with her to the USA? What does the document say? How is it worded? I appreciate any info. She'll be coming from Ukraine.

You add information about kids into the petition. Visa k2 will be open for them but only if your fiance has papers from her former husband that he allows her to take kids to another country or if she has a decision of the court, custody papers that allow her not to have a permission from her ex husband.

Guys, I am hoping that you are telling me I do NOT need a 'court decree'. You seem to be saying that a signed and notarized statement by the father, her ex-husband, would satisfy the requirements.

I'll tell my fiancee to ask her ex to sign a statement that says, 'I give up my parental rights and give permission

for my sons, Viktor Jones and Nik Jones, to relocate from Ukraine to the USA.' and have it notorized, dated.

Okay, do I have this right? Thanks for any advice.

Big difference between letting his kids immigrate to the U.S. and giving up his parental rights.

He may want to let his kids immigrate. He may not want to give up his parental rights.

It's my understand that the natural father/ex-husband, only wants to stay in communication with his sons, using phone and skype. What sort of statement should we get from him? His sons have already traveled from Ukraine to Poland and back with their mom, so they have those travel documents....

Notarized document from father giving his permission for the children to permanently immigrate to the US and then to travel back to Ukraine and then return to the US. Use those exact words. This document will be needed for the visa petition process AND the children will need to present this at the border each time they want to leave Ukraine for the US.

A few more ideas. Tell me what you think-

The statement from the ex-husband, should be notarized AND 'apostilled'

and drawn up by a Ukrainian lawyer. In addition, it would help to have a copy

of father's birth certificate. Someone also mentioned the idea of having separate

international passports for each son, rather than having them grouped onto

her passport. What do you think? Also, an official translation from Ukrainian

to English.
