IRS decides these things all the time. Courts are used all the time to decide what religious practices are allowed in prisons, schools, workplaces, etc.

that's not deciding if you're a real follower of a religion. that's determining if you qualify for an exemption due to the religion you claim. not at all the same thing.

Courts have already decided also that certain people were under religious protection when they claimed to be Wiccans and don't even go on about the ones that claimed a food strainer as a hat was a religious practice.
