I-130 for stepson

I am bringing my stepson to US as a I-130 visa , my question is if this kind of visa needs to start AOS after entering the US? and how long it takes? and how long it takes to arrive his green card? After his I-130 visa be approved he will visit us for a month and then he will have to come back to Mexico and finish school (dec 2007) and then stay here permanently. Maybe a travel document will be ok?

I-130 is not a visa.

He is entering as a Permanent Resident it sounds like.

Green Card would arrive a few weeks after he enters.

Quite common for people to enter the US to activate their GC and then leave to finish things up, in this case schooling.

You need to check about current Mexico consulate processing times, I seem to rmemeber a year, but that was some time ago.

Thanks Boiler for your kind reply, so I understand that after he get approved as a permanent resident and enter to the states, he wont need to start the AOS process just wait a few weeks to arrive the green card? In our case, he will be able to stay here for one month then he will come back to Mexico and continue studying there, we are wondering if he will have problems at the Port of entry when he tries to visit us again.

By the way I am k1 holder, started my AOS, i didnt included him as a k2 because my son wouldnt be able to stay here permanently yet and wait the process of AOS as I did. (I just mention him in the documents)

K visa's are non immigrant so you have to adjust.

They are the oddity, otherwise you come in as a Permanent Resident.

Downside is that they usually take longer, as a Fiancee you only have the option of a K1.

He should get a I-551 stamp in his passport, which allows entry by itself, but having the GC is a 'safer' bet.
