When we get the letter with a date for biometrics, we are allowed to do a walk in earlier then scheduled? If you do a walk in earlier then scheduled do you still need to return on your scheduled date?

Obanla, can you answer this for KM, since you did the early walk-in already?

A couple here, Insomnius and Obanla did the early walk-in for Biometrics.

However, I read in some of the other threads that some have been turned away and told to come

back at their appointed time.

So keep that in mind if you have to drive some distance to do the biometrics.

I'm the beneficiary and my husband is the USC.

I'm on mobile so I can't link right now, but you should be able to find reports from applicants that attempted to walk in at your local field office - what te they went whether it was successful etc. It's in a subsection of VJ.

Well as long as you have one the successful walk in , you have no business going there at the original day, you have nothing to do there again , and where I did mine, the lady did not even asked to know when I was suppose to do it ... she just took the letter and signed me in like every other people there.

KM, I am not expert, but was looking at your timeline (for your husband) and it is interesting.

On the one hand, we always say that once someone marries a US Citizen, all is forgiven concerning

overstays and unauthorized work.

But a big caveat is that the person must have entered the USA legally.

Here is some legal info:

Unauthorized Employment, Unlawful Status or Failure to Maintain Status --

Aliens who have engaged in unauthorized employment, or who were not in lawful status

at the time of filing the adjustment application, or who have failed to continuously

maintain status for even a single day since their entry into the United States

are barred from adjustment of status.

This rule has several exceptions, which include:

Immediate relatives (spouses, parents and unmarried children under 21-years of age)

of U.S. citizens are still eligible to adjust their status.

To AOS you have to: 1) have entered legally, 2) have a qualifying relationship on

the basis of which you are adjusting, 3) qualify financially, 4) Prove you have a

valid marriage - - - this is the focus of the in-person interview.

Since this DACA is relatively new . . . I doubt there have been many test cases.

I am definitely interested to see how it proceeds. After he was first awarded DACA we spoke to an immigration lawyer who recommended that he apply for Advanced Parole (I-94) and after leaving/re-entering legally applying for AOS. I am mostly just wondering if his case will be handled differently because of the DACA or if it will be treated the same as an overstay.

Thank you, I truly hope so too! I have heard multiple stories now of USCIS screwing things up or losing material, sigh.

That was like my biggest fear when mailing, that somehow the checks would magically unclip and get lost. I hope they are a bit more thorough for you this time.

I did my walk-in biometrics successfully right after I got the appointment letter. No questions asked! I was only me in the office! LoL

My place is only 4 minutes drive from the ASC. Now I hope everything is ok so I can get my EAD card soon enough.
