Hi guys I was wondering if you could help me.

We are currently pending the decision of an I-485 application that was filed March 2013.

We received a notice in the mail around the middle of January titled "Notice of Intent to Deny" due to failing to provide a completed medical vaccination form. We were advised in the letter to provide a completed i-693 form transcribed by a civil surgeon.

My husband did complete his medical as part of the K-1 fiance visa requirement but later found out his vaccination history was not marked complete on the form. (oversight on my part)

We have seen a civil surgeon and $400 bucks later (grr) obtained the completed vaccination i-693 sealed by the civil surgeon and sent back to USCIS on yesterday,

My question is--has anyone came across this scenario before and if so--once they sent back the required documentation how long did it take before hearing from USCIS regarding a decision?

6/19/14: Received Text/Email that EAD Card is in Production and has been mailed

6/27/14: Received Potential Interview Waiver letter
7/14/14: Husband starts his new job
01/16/15: Receive Notice of Intent to Deny letter due to incomplete medical

01/28/15: Completed Medical

01/30/15: Received results in seald envelope-now marked COMPLETE!

02/02/15: Mailed results back to USCIS

Sounds like some time around the middle of October the USCIS sent you a RFE (request for evidence) for a complete medical that you did not receive. They typically give you 89 days to respond. If you fail to respond, they will assume you no longer are interested in pursuing the application and will issue a notice to deny. We had issues with my wife receiving mail at our apartment. Is your husband's name on the mailbox and have you gone to your local postoffice and submitted a lits of names that are to receive mail at that address? If not, then the substutite letter carried may be returning mail even though it is properly addressed. Did you sign up for text messages from the USCIS for case status? If not, then you might have missed them saying they have issued an RFE and that the RFE had been returned by the USPS.

I never received any documentation and I did sign up for the text alerts--the website status has not changed either although I know that is not the most reliable source.

In the letter they did advise to return the medical docs which I did this week so it appears that as long as they receive the completed form that my file will be decisioned accordingly based upon receipt of the doc.

The wording that it is an intent to deny is a bit harsh and I wish they would simply send a request for evidence instead. They wanted an I-693 from you in order to finish adjudicating your case. You supplied it, so you should be ok now.

Thank you so much--I feel a little bit relieved hearing this--yes seeing DENY is very harsh--they need to change that verbiage lol.
