Yeah, i knew it was not an option but then my husband spoke on the phone to her and she explained this.

would it be ok to fire her after i130 is received, without slowing anything down

you can fire the lawyer any time you want, just make sure you notify the USCIS and remove him from the case.

Yeah.. it seem like i am constantly correcting her to be honest. waste of money and probably time!

Going to play it cool until i receive the i130!

I had my heart set on the K3 when we started this long journey. Everyone on VJ told me I was dreaming. And they were correct. We hired an attorney and it was a waste of money. I did 95% of the leg work . I could never get the lawyer on the phone. I could never get the lawyer to answer simple question via email. The entire law office was slow as molasses . They had ZERO customer service skills and treated me like I was annoying them. Our case took 11 months to be approved just for the I-130. Mind you, I only tried to contact the lawyer 5 times during that time. I spent many hours reading posts on VJ to get my info. When we got to the NVC stage, the lawyer made a huge mistake that I had to correct. ( they used the wrong income amount.... and they insisted we would not get checklisted because it was well over the 125% poverty level.... well, he was dead wrong. ) I knew how to correct it immediately because I read the NVC wiki on VJ. I did everything for the NVC and for the interview and all the follow-ups. I contacted the senator's office when I needed information because the lawyer was useless. The lawyer even filed our waiver incorrectly with the incorrect waiver fee and it got rejected. I can't even tell you how angry I was. The waiver was approved Dec 17th 2014 and the lawyer didn't even send me the approval letter until 3 weeks later. I contacted the embassy and took care of all documents needed for the visa. Husband entered the US January 18th of this year. Just yesterday I received an email from the lawyer asking me if I have heard anything from Costa Rica. I completely stopped contacting the lawyer because I could never get a straight answer or get someone to answer my calls. The lawyer is not even aware that my husband is here. He is under the impression that I am still waiting to hear from the embassy. smh

Save your money. Get rid of the lawyer and hang out here. Join the thread for the month you filed your I-130 so you can follow the progress and get an idea of when you will be approved. Also, read the NVC WIKI over and over again. It is a step by step guide that will get you through the NVC without issues. When your I-130 is approved, Join the NVC thread and follow the progress. Add your name to the spread sheet so you can stay informed. I would have been lost without this site.

Yes hire a new lawyer or finish the process yourself. K-3 visa while it is still in use. It is rarely giving out now. The Advantage was that it was a faster way for your spouse to get to the USA, while waiting on the IR-1/CR-1 visa that advantage has long disappear as the IR-1/Cr-1 visa is not taking as long as it use too

The main Disadvantage is if you did the K-3 visa and was able to use it you will have to do AOS later in the USA

The IR-1/CR-1 there would be no later AOS ,as everything will be done before visa is issue and your spouse will automatic be a legal permanent residence.

So there is really no reason to even suggest the K-3 visa. A good or even halfway decent Lawyer would of know that.

Darnell is right.

We filed the I-129f for a K3 right after we had gotten our NOA1 from our I-130 petition. The latter was approved in April 2014 (5.5 months), the I-129f in July (9 months!), however. Of course, it was closed administratively because the I-130 was already being processed by NVC. In my opinion, it doesn't save you any time with the service centers being so severely backlogged right now and, in the end, it's also the more expensive option with having to file for AOS in the US for around $1k. It doesn't hurt to try it since filing an I-129f after an I-130 is free (as mentioned before in this thread), but don't get your hopes up too high as we unfortunately did in the beginning. Good luck!

There is a little chance for K3 to be processed....

Time frame? Same as is for CR1 these days.....

Al together about a year.

If you want try you can file petition for K3. It is free! Just need NOA1 from I-130 and form I-129f.

But in my opinion...forget it...wait for CR1.
