Hi Guys,

Long time no see...

My husband and I went through all the visa stuff to get here to Cali already almost two years ago. Time FLIES!

I'm so nervous about the upcoming visa stuff this year though :crying:

So, I thought I'd come on here and list everything we have so far with both of our names on it, and our proof list, to see if we can't work on getting more stuff together in the next few months :)

Proof:

*Pictures

*Marriage Ceritificate (We got our marriage blessed in our catholic church, so we have a church certificate with the date of Dec 6th, 2014 on it, as well as more photos)

*Health Insurance (they didn't put both names on the sheet, but they sent out a form with both cards on it, so I scanned it. It doesn't have our names grouped together, but on the same page to the same address)

*Car insurance (Page with my name, and his as a NON designated driver on my policy) He can't drive due to severe dyslexia (we're working on that too).

*Employment verification from Walmart (where he works) plus a few paystubs, with our joint bank account number on them, the address, and the tax status of "married" marked in the middle.

*Joint bank account statements (both our names)

*We're taking a trip to disneyland on the 10th, so the hotel papers will have both our names on the reservation, along with our credit cards and more pics of the trip.

*We're going to get letters from our priest who married us in church, as well as his reading tutor (who tutored him with me, she knows us as a couple), and his sponsors for his baptism and initiation into the church, who know us as a couple as well. We also have pics of all that stuff....

*Notarized letter from my parents saying we've been living under their roof, paying monthly rent since Oct 2013.

*We had some christmas cards sent to us in both our names so I kept the envelopes/cards

*We'll be filing our taxes for the first time together this year too, so married filing jointly, with tax forms to show by October.

Should I be concerned? I tried to gather as much evidence as possible. With him not being able to read, and me doing the driving and the bills his name can't be added to a lot of the things...

I have a cell phone, but he doesn't really ever use them except for emergencies, so he's a go phone (pay as you go) under his name, so his name isn't added to that either.

Our car is in my name, because they only allow one name on a lease as the main car holder... and since we don't have an apartment/home, we don't gather a lot of utility bills to our name, as you can imagine...

I heard this is one of the hardest processes to go through, harder than what we already did. So I'm VERY nervous....

I changed our address on the website, since we moved in April with my parents, but I heard sometimes they still send stuff to the old house. How can I stay on top of that?

Thanks guys! Glad to be back, but dreading every moment of it

*EDIT**

I forgot to add we got in two medium/major car crashes (other person's fault, we were rear ended, and car almost totaled). Once in March, so physical therapy for a few months, and then again in October, physical therapy again for longer (we were hit by a ford excursion to our little prius, so pretty bad back and neck injuries)... So can I use the physical therapy place as a letter? They can say we attended therapy there after the crashes? Also, our lawyer who got us our car fixed and money back? Can I use him as a reference too?

So, I thought I'd come on here and list everything we have so far with both of our names on it, and our proof list, to see if we can't work on getting more stuff together in the next few months :)

Proof:

*Pictures

*Marriage Ceritificate (We got our marriage blessed in our catholic church, so we have a church certificate with the date of Dec 6th, 2014 on it, as well as more photos) fluff piece, skip it

*Health Insurance (they didn't put both names on the sheet, but they sent out a form with both cards on it, so I scanned it. It doesn't have our names grouped together, but on the same page to the same address) this is good

*Car insurance (Page with my name, and his as a NON designated driver on my policy) He can't drive due to severe dyslexia (we're working on that too).

what I lined out is not relevant, adding him to the insurance is good

*Employment verification from Walmart (where he works) plus a few paystubs, with our joint bank account number on them, the address, and the tax status of "married" marked in the middle. skip this, the joint bank account statements are sufficient

*Joint bank account statements (both our names) good

*We're taking a trip to disneyland on the 10th, so the hotel papers will have both our names on the reservation, along with our credit cards and more pics of the trip.

good (and also have a fun time)

*We're going to get letters from our priest who married us in church, as well as his reading tutor (who tutored him with me, she knows us as a couple), and his sponsors for his baptism and initiation into the church, who know us as a couple as well. We also have pics of all that stuff....

Affidavits carry little to zero weight in the overall evaluation of the file, skip them. You have plenty of other evidence.

*Notarized letter from my parents saying we've been living under their roof, paying monthly rent since Oct 2013. good

*We had some christmas cards sent to us in both our names so I kept the envelopes/cards good

*We'll be filing our taxes for the first time together this year too, so married filing jointly, with tax forms to show by October. very good

Should I be concerned? I tried to gather as much evidence as possible. With him not being able to read, and me doing the driving and the bills his name can't be added to a lot of the things... IMO, I don't see anything you need to be concerned about.

Your situation is your situation, you work with what you have.

I heard this is one of the hardest processes to go through, harder than what we already did. So I'm VERY nervous.... Personally, the worst part is waiting for a decision. Whether or not one finds this process hard is a matter of perspective. From my point of view, it's less stressful to show how you are living together as a married couple than it is to show your a legitimate couple in the first place.

I changed our address on the website, since we moved in April with my parents, but I heard sometimes they still send stuff to the old house. How can I stay on top of that? You did your part by changing the address. Just use the new address when the I-751 is filed. My wife and I changed addresses between the time she arrived and the time she had to file to remove conditions. Correspondence always ended up in the right place.

See my above answer regarding affidavits.

We had all the same documents that the 2 of you have, but USCIS says we don't have enough and they consider our marriage to be fradulent.

I'm sure you will be fine.......good luck to you.

I have seen applicants approved that had less documentation than we provided.

Thank you for your help... Is it bad to add things in that aren't relevant? Even if they don't mean much... I still liked to add them (even in the last visa we did) cause I felt like it showed we cared enough to gather little things that might not even help?

Also, should we write a cover letter explaining why we might not have as much evidence as others? (Utility bills cause we live with my parents, phone bill, car in my name, ect...)

Sorry to hear that :(

Did they give a reason as to why they considered it fraudulent? It couldn't be just because you didn't provide enough. That doesn't mean you're fraudulent, just that you need to send more evidence.

Was there a red flag that went up for them? Something you included that seemed "off"?

Frankly, OP, you're sweating this too much.

If you want to add something, skip the fluff. Instead, craft wills, medical powers of attorney, HIPAA releases, and associated documents. These make outstanding evidence and are even more valuable in "life" than as ROC evidence.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

That's a great idea... I was thinking of signing up with Legal Shield and getting us wills to our names...

Also, I forgot to add in the original posting that we both have life insurance for ourselves, and named each other as beneficiary's should something happen to the other. In our names to this address, so that should help, yes? :)

No such explanation is needed.

My husband and I are buying a dog from a breeder, he will be in both our names with his papers. Fluff piece, or good?

Fluff, but OK to include. The important legal documents of above will certainly carry the most weight.
