My fiances date of entry was Febuary 24th the priest cannot Marry us until May 20th because my fiance is catholic and we have to attend all of the meetings in an express catholic wedding, lol. Is this going to be a problem if we cannot file within the 90 days. I plan to have it all mailed assuming i can get the marriage certificate in time. Has anyone had any experience with this, Thank you in advance

07/2004 Met online

05/03/2005 Made the trek to Argentina and met in person for the first time and spent a month and fell in love with the most incredible person I have ever met.

07/01/2005 Sent I-129F

09/15/2005 Went back to Argentina for two weeks to meet the family was an amazing trip.

12/16/2005 Agus delivers the paper work to the embassy and gets the interview date set for January 13.

01/12/2006 I am going crazy with anticipation and worry.

01/13/2006 Visa approved

That 90 days...Thats the time alotted for you to be married here in usa once u arrived here in k1 visa and I should say that there is no problem if you will apply for an AOS within that 90 days because I've done that my self and it worked alright, for as long as you follow what you have said in your letter of intent and that is to marry within the 90 days and the clock starts clickingl upon arrival...

It's not a problem if you don't file within the 90 days, although the sooner, the better.

It is a problem if you don't marry within the 90 days. Your fiance will be out of status and accruing overstay, and you will have to file for AOS based on an I-130 petition rather than the I-129F which you already have approved. I don't know about the particular problems that may cause, but it certainly means paying an additional fee for the I-130 if nothing else.

May 20th is day 84, by my calculations, so you should be ok. Don't push it out any further if you can help it!! Also be aware that if your fiance wants to get a SSN, that must be done 14 days before the exiry of the I-94.

If you do not marry within the 90 day K-1 time, then she must leave the country. Period. No exceptions. No more K-1's between you and her. That's the law.

If she overstays her K1 before leaving (i.e. 91 days in the US), then she will be barred from reentering the US for any reason for some period of years.

Married on Day 84? This could be cutting it a little close. Is she willing to risk potentional heartache because of church imposed man-made docterine? (I'm catholic too, BTW).

Might want to work on a contingency plan if there is a problem with the priest, classes, or marriage certificate when resubmitted to the courthouse, death in the family, or car wreck on the way to the wedding. You gotta be married within the 90 days...There is always Vegas, BABY!

Yes, the church wedding is fun and exciting.... but get married ASAP even if it's at the Justice of the Peace.

You can be legally married in the eyes of the State and US Government and then later get married in front of all the world in Church. I don't know if the Catholic Church would frown on that , but I would just do it...

We had a small civil service in November and then had our own wedding in Feb. that I wrote and created, since we wanted to do something a little bigger than just the JP...

Get married at the justice of the peace first, then apply for AOS, that way your safe and within the 90 days. After wards then do the church wedding. Thats my plans, the week he is here we are getting married, then around June, when school is out for my daughter and my family can take summer breaks from work to come down here to be here for the celebration we will do the traditional church wedding.
