Fingerprints for FBI Background Check prior to filing visa

My lawyer recommended we do a FBI fingerprint background check prior to filing for our K-1 visa. This is being recommended because my fiance had illegally entered the US 10 years ago and was caught and released by immigration. Finger prints were taken at time of catch and release, however he did leave "voluntarily". My lawyer just wants to confirm if there is a record of this. Has anyone submitted fingerprints to FBI for background check outside of Visa process? If so, when and how long was your turn around time for results? My lawyer said turn around time is usually 2 to 6 weeks. I am a little nervous because the FBI website is saying that delays are occurring and processing time is 14-16 weeks (since Sept. 2014). Have you submitted for background check and received results?

the time frames with the fbi fingerprints can vary, at least thats what i have heard. however, i have always seen that a FOIA is filed to see if anything would be on his record immigration wise. you may want to ask your attorney about those. the form is free however, the wait can sometimes be a little long. sometimes your local congressman is able to help with getting it a little quicker.

We have already done a FOIA and the results came back as no record, however, because we didn't have any alien#s or very specific information to use on FOIA other than name and date of birth and approximate date of catch and release this may not be reliable. We actually received these results in a week!
