Re-entry after long stay on B2

Hi everyone,


This is a question related to a longer post I have made Fiancé visa forum, but this part best suited to here:


I am a UK citizen currently in the US on a B2 visa (first use, previous visits were on visa waiver) - I was granted a 6 month stay and I will be staying for this entire duration.


My partner and I are submitting an application for a fiancé visa, and we are trying to minimise long periods of time apart. He is working in Canada from May to mid-August.


I am trying to figure out when I can come back - i.e. whether I MUST remain out of the US for 6 months, or whether I can return in say, mid-August (4 months after this visit).


I am also trying to find out whether a month trip outside of the US to latin America in March, before I return to the UK in April would be a good idea and would allow me to return earlier. It would of course mean another entry for a week or so before my return flight to the UK, but would also mean 1 month less out of the past 12 in the US, therefore surely allowing me to return earlier. My understanding is that the general regulations with a B2 are 6 months out of every rolling 12 months allowed in the US


I have had 5 trips total to the US - first in 2010 on J1 internship; second March 2011; third 10th Dec 2012 to 3rd Jan 2013; fourth 26th March 2013 to 30th April 2013; fifth this one, entered 10th Oct, flight out 7th April - the exact date the I-94 is valid until - we were planning on travelling to South America but it fell through.


Any advice would be greatly appreciated

I mentioned in your other post that there is no time limit regarding how long in any year you can spend in the US.

You could be gone for a day and seek another 6 months.

Nor can anybody tell you if you will be allowed entry or not.

Rule of thumb is to be gone as long as you were in.

If you return to the US right after a 6-month stay chances are you'll be questioned by CBP, especially if you only leave the country for a short period of time, i.e. one month. That does not mean you won't be let in and given another 6 months but you must be prepared to show evidence that you have means to support yourself for the intended stay and be certain to have a return ticket home handy in case you're asked.

It can be done but your story and evidence must be water tight.

Thanks for the advice. Sorry everyone, I know it's annoying to ask for answers when there isn't one, just trying to get a feel for the situation (i.e. find out how much I need to worry or whether I should be feeling as depressed and frustrated about it as I am!) and trying to plan for the future. Maybe things will work out and I can make a little visit in August...
