I-485 Mariage based VERY IMPORTANT QUESTION !!!!

Hi,

I have a very important question about I-485 already filled.
We sent I-485 to the Chicago lockbox in April 2014 and we had the interview in October 2014.
All my paperwork was done by a lady (not a lawyer) that has extensive experience into this.

On I-485 are 3 questions (15a, 15b and 16) that has been marked with the answer NO by that lady that filled the I-485 form.
The think is ... I'm thinking now after has passed 3 months since we had the interview ... and the case is pending consideration ....

I was a military officer and before that I was a student at a military high school and military academy back in 1984-1991.
Since 1991 to 1998 I was an active military officer (finance officer) and my last rank was captain until 1998 when I have quit from the army. (Romania)

I came to the US in 2000.

MY QUESTION IS WHAT TO DO NOW?

I didn't pay much attention to the questions the IO asked me and all my answers was NO because that lady that filled my I-485 didn't told me and didn't asked me about my military service.
Also I was thinking those questions was about paramilitary / terrorism training!!!!!!

I believe it is time to contact a real experienced attorney for your matter, On USCIS website, there is a banner "WRONG HELP CAN HURT".

All military trainings / practices must be disclosed, a contradictory answer with your fact could hurt more than you think. It is misinterpretation, which is even more severe when it is involved with military thingies.

Since your case is still pending consideration (lucky you) and has not been completed yet you still have a chance to make things right.

You need to submit an amendment, which is just a letter, explaining the mistake, and asking that the correction be made. Make sure it is sent to the place where the I-485 is under review, and make sure to provide the Receipt Notice number, so that the officers can put it with the right file to make the corrections.

You should probably bring this to the office you had the interview at and hand it to a person, supervisor preferably as well as sent certified mail to the service center.

From my understanding checking yes to those questions is not an automatic oh no denial red flag type of thing. Normal military work in a country is common, some countries require it. It gets tricky if you are from certain areas that engage in questionable things like torture. So in your explanation or for anyone that checks yes its a good idea to attach an explanation page of what kind of military involvement you had- as you can see the question is quite encompassing. (vigilantes- guerrilla groups and regular military and then goes on to 16 have you been in a unit that used weapons on people..)

So you would explain you were in the military academy and worked in the finance office. Your job duties, if you saw combat etc etc. If you did or did not have weapons training, if you used it. Being in the finance dept sounds pretty mild- they are looking for abu ghraib type militants which is so ironic since they were Americans.. but whatever.. Just do it before you get approved or denied or it will be a mess- so like write it tonight and be there tomorrow.Or go to an attny and double check and from their office go directly there....

You had that chance at interview but you still insisted NO. You need an attorney. Good luck.

like Nancy said go to an attny for a free consult before you get approved or denied. Esp if you dont even remember what was asked in the interview. If they asked is everything correct on the form and you said YES. Then I dont know if the format below is what you need or if you will something more-

If you have to pay for the consult then pay for it. You need one. You need to fix this asap.
