Hello!

I have a huge question: is it possible for the alien fiance with a tourist visa to file all the forms and get through the procedures and the interview in US?

I heard that could be easier and faster but I want the things done in the right way.

What is your advice? Please help!!

I don't think it will be possible. The time involved will not work. Your k1 will go to Texas since you are in Mass. The time line on these is running at 6 plus months to go from Noah 1 to noa2. The Interviews need to be done in his/her country. That is what I understand from the forums.

Stay and adjust would be the first thing to consider.

No.

Otherwise everyone would do that.

Beneficiary needs to be in their country of residence for the medical and interview.

These cannot be done in the usa.

This is baring in mind you are doing a K1

Staying in the usa on a visa with premeditation to stay I believe is fraud.

Google the website for answer on tourist and AOS.

Can't and wont help you there.

If you did not intend to do so when you arrived, then you can remain in the US, get married and apply for adjustment of status. It would be illegal if this was premeditated, however if it has suddenly become the best option, then this is permitted.


However, if you want to file a K1 petition they must return to their home country to have their medical and be interviewed (or another country where they maintain a legal presence).

Immigration Timeline

 

June 2013: Met whilst working at a summer camp in Michigan 

K1

November 1st 2014: I-129f submitted for K1 visa

February 24th 2015: Visa in hand!

February 26th 2015: POE at Las Vegas airport, then onwards to Oregon! 

March 6th 2015: Marriage (with a "real" wedding to follow next year on 7/6/2016)

March 9th 2015: AOS, EAD & AP submitted

September 22nd 2015: Interview

January 14th 2016: Two year Green card received -phew!

ROC

August 8th 2017: 90 day window begins! ROC time!

September 28th 2017: Biometric Appointment in Portland, OR

March 5th 2018: Case received by local office

August 18th 2018: 18 month extension letter mailed

December 2018: Case moved to another office

February 2019: I was emailed that I was approved and my card was in production the same day of my N400 interview 😂

No interviews are conducted in the US, only at the home country US Embassy.

I heard that could be easier and faster but I want the things done in the right way.

You can start the process when she is in US, and she can stay for some tome during the wait, but just like everyone said she will have to return timely for the interview and medical to her home country. That's what we are doing, but we're in CSC.

We didn't start the procedures,she is here since November and we try to figure it out if there is a way to keep her here.
