Hello all,

I'm in serious need of help!

I have now moved to the US on my K-1 to be with my fiance. We are getting ready for the wedding and everything but there is a huge problem: In order to apply for AOS, we have to prove joint ownership of something, right? Well, my fiance isn't making a lot of money (we have a joint sponsor) so he is still living with his dad. He's therefore not paying any rent, utilities, and has no ownership or lease over his car.

I arrived 8 days ago on the K-1. We wanted to open a joint bank account (with Chase bank), but the bank says I need some proof of residence or a state ID.

Proof of residence would be a bill of some kind. I have just signed up with a phone service but it only does online bills. They would have my local address on them but the bills wouldn't be sent through the mail. I can only print them up online.

Problem is: We have literally no backup. I just found out that I can't get a state ID of any kind unless I have a I-551, refugee/asylee status, or Green Card and we need to open a joint bank account before I get a Green Card.

This is turning into a huge Catch-22. I feel like I can't do anything right now. My hands are tied.

What is usually done in these kinds of situations? Can somebody please help me or give some advice?

How many forms of proof of joint ownership do I even need?

Relax. You do not have to prove joint ownership of anything when filing for AOS. You do not need to include any proof of your bonafide marriage or anything.

The only thing you need to include with your AOS application is EXACTLY what the form requires. As far as your marriage goes, the only thing required is the marriage certificate, and it is ALL you need to send.

When we sent in our AOS application, we didn't include any extra relationship proof. We didn't even include photos. We just included exactly what the instructions required.

i suggest this:

1. apply for ssn at ssa office in VISA name, showing the I-94 and passport. go back into ssa office the next day and they will give it to you. You can then, easily, get a bank account, as the major hurdle [a ssn] is already jumped over.

2. adjusting from a K-1, there really is not that much evidence required, except for the marriage certificate. OTHER ADJUSTMENT TYPES, ie - adjusting from a tourist visa or work visa, have different evidence requirements, as an I-130 is included, so the rules from the I-130 are used. This is not the case for you.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I don't understand. So when do we have to prove all of these things if not when applying for AOS? At the interview?

Sorry, I've been studying this process for years and it's in the process of driving me crazy.

I could have sworn we have to prove joint ownership, etc. sometime.

No co mingled evidence required for AOS but for ROC.

As far as a state ID you can get it with the SSN ( do as Darnell suggested) and then try with the I-94 that you print out from online to get

a state ID. Some DMV accept this and some want to see more such as the proof that you have filed for AOS or your EAD and two proofs

of your address with your name on it.

We got the state ID with the I-94, the SSN and proof of address at the second DMV we tried, the first DMV refused and said he needed at least 6 months

on his visa left which of course does not apply to the K1 at all. Different states have different regulations and different DMV's within a state interpret the

regulations differently. ;)

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

With the initial AOS filing, the only proof of marriage you need is a copy of your marriage certificate. If you should happen to get an interview, then you should bring evidence with you of co-mingling fiances and co-habitation. Adjustment from a K-1 does not always include an interview. You could be approved without one. If you do get an interview, the IO will know you have not been married long and are pretty understanding about not having a lot of joint documentation. By the time you would have an interview, you will probably have been able to get at least some joint evidence of a bona fide marriage.

Later for removing conditions from your 2 year green card, you will need more evidence. ROC is all about proving you have lived together as a valid married couple.
