Can anyone please quide me regarding a case that i want to file for my citizenship?

I am Adeel Y. Malik 28 from Karachi, Pakistan. I want to discuss my case with you and if possible need quidance.

Me and my whole family got Green Card in 1988 and my Mother got her citizenship in 1995-6, at that time when my mother got her citizenship I was about 10 years and legally I think at that time I was also legally eligible for my Passport. Unfortunately we didn't know the procedure and were unable to file a case.

Meanwhile I came back to Pakistan in 1995-6 and was unable to go back to the US due to some domestic problem. Now I want to move to US with my mom.

My sister who's in NY asked the US Counselor Lady about my procedure since she told her that we were already citizen, the Counselor Lady said and I quote " Your Brother is already a US Citizen, and he doesn't have to wait for your Mom or you to file a case for him he can file it himself ".

The Counselor also said something about a Law which was passed in 1986 or in 2001 about people born in 1986 about their citizenship and something like that. She also told my sister that it'll take 6 to 12 months for my case.

I'll be thankful to you if someone can please quide me as to what case shuold I file.

It looks like you're eligible for Derivative Citizenship

Derivative Citizenship Derivative citizenship is the avenue by which a child born outside the United States becomes a citizen upon the naturalization of a parent or parents, subject to certain other conditions. Under the current law at section 320(a) of the Act, 8 U.S.C § 1431(a): A child born outside of the United States automatically becomes a citizen of the United States when all of the following conditions have been fulfilled: (1) At least one parent of the child is a citizen of the United States, whether by birth or naturalization. (2) The child is under the age of eighteen years. (3) The child is residing in the United States in the legal and physical custody of the citizen parent pursuant to a lawful admission for permanent residence.

The form is N600. However, there are requirements for your mom to have lived in the US for a certain amount of years. I am not sure if you fulfill that. Is she still in the US, or did she leave with you in 1996?

Thanks for the reply Dohan.

My mom came back in 1996 after her successful bone marrow transplant, she was a cancer patient. We had to come back to US, but unfortunately my father's health was not stable and after few years of his bad health he passed away, because of which we were unable to move back to US.

How can I get my Citizenship? As I am planning to take my mom and settle in US.
