I agree that the thread should remain open. It’s a safe place and community for all of us during this trying time.

For more selfish reasons, I don’t think I could face interview day without this thread. A dark cloud of fear has settled over me regarding our impending interview at Cairo (which is still yet to be scheduled). It’s a difficult situation because my husband is usually the person who calms me down and who I share everything with, but I’ve kept my worries to myself because I don’t want to transfer any stress to him (he’s the one interviewing).

God bless us and have mercy on us all. At least the process is temporary, even if it lasts longer than we want it to.

I know all will be well with you and your husband, we have a few red flags one we can't retrieve our Yahoo and all our Skype calls since they only keep 6 months worth, didn't even cross our minds we would need them so when we stopped talking on Yahoo, voice was easier on Skype well we can no longer download the old Yahoo messages. :( That would have been such a blessing and phone call logs we talk only via Skype and we have a lot of those but not the really old ones. Also I have very few pictures and haven't been able to go back since I had to return to the USA.

So you see you will fly through and you will both get your Visa plus we will all be praying for you. And don't worry I wont close this thread I was just in a very bad place that night. Much love and hugs my sweet and dear friend.

Thank you Sylvia. And yes the number seven means so much. We both said seventh time? This will be blessed. :)

And your mom is a smart lady :)

And dutchmans lady is correct

We did choose this path of all this but only because it was already destined to be. That's what I believe.

Jac

Your very welcome precious and my mother bad that I say it is brilliant :D

I agree Dutch is right we did choose this path and I for one am not sorry for having taken it!!!!!!!!!!!!!

Soloenta, I am so happy to hear you will not close this thread. This thread was such a blessing for me when I found it because felt lost, alone, and felt like no one knew what i was going through. You have provided so much hope and optimism, and support, things changed for me for the better. Even thought I have been at NVC for so long, almost 7 months now, I know the day will come when i will my CC. You have provided so much moral support to so many people, even if they don't say it, i know there are many silent readers. (i used to be one, it months for me to have courage and start posting). I feel horrible for they way things turn out for you. I feel is unjust, unfair and wrong. I hope you get to fix things. You a blessing for us!! We love you and this thread. XOXOXO

This NVC process is getting worse and worse everyday. I can't believe NVC/USCIS get to delay processing indefinitely, and they're not accountable for that.

60 days is already too much, considering that most of us spent ~1 month to get a case number, and for me another month to pay fees.

And after that we have to deal with embassies interrogations.

This is not fair, that's all I want to say.

Solenta, what have you done with your case since the interview? any contact with the embassy, lawyers, anyone?

Yes sorry just got off the phone with a lawyer and was told, it's better when denied to withdraw the I-130 and start again it takes much less time was quoted 18 months and more to let it take it's course from being send from Embassy to NVC to USCIS back to Embassy. If withdrawn then 6 months not sure if thats the whole process but It think it must be USCIS then the time it takes at NVC again. Right now I have to try to get the texts from my cell, it says on the net there is no way but there must be a way. The lawyer said to try to get the oldest paper work as in Yahoo and Skype coversations as old as I can get them but it seems you can't get more than 6 month back on Skype and Yahoo I can see old messages but they don't go as far back as we started talking which was 2007. I need a genius to help me out here or someone that works for these placed they do not answer their e-mails. :(

Awwww thank you so much my precious friend and your welcome for what ever I could have done to help you in any way. But I thank you for all the support you gave me and so many others, for me you and those on this thread are the blessing and I'm the lucky one.

I love you guys to and in a funny way I feel like everyones mother. Your all getting close to being adults and I know you have to fly and spread your wings when finally you get to live your lives. God bless you and all of you reading this post.

That's really messed up, Soloenta. USCIS/NVC already approved you, why go back there again? It's the embassy that rejected your husband, and they should provide a clear explanation why, and give you a chance to defend yourselves.

I really don't know who would listen to us, NVC/USCIS are used to hearing from congressmen, and they're getting worse and worse (at least NVC), they don't care. The whole system is broken.

I agree but we are in their hands they are our mommy and we are the babies. I agree there should be full disclosure of what they/we are being accused of but most of all they need to be held accountable for their actions and stripped of the power they have over us. No one should have this much power all by themselves in our personal lives no one.

I agree if our Congress person/Senator/Representiative can't help us then who can? What happend with the persuit of happiness we were promised?

Solenta, what are your red flags? Now be truly honest with yourself.

I have answered you question honestly at least twice and that of others, I have nothing to hide and have been very forth right. So I'm sorry I have nothing more to add. Lack of pictures, Skype screen shots show time of call duration some text because we rather hear each others voices than type, no phone/cell records because we pay as we go, some text messages from way back in 2008, I had to come back when my parents became ill or this most likely would not have happened they asked about this. We met than married shortly after I'm not rich nor is he we can't be traveling all the time as others can. Yahoo and Skype seem to only go back so far in saving messages and since we are not frauds didn't think about saving them.

I would think a fraud would know the ropes and have ton's of evidence, I know of one that the parents were involved taking pictures with the fiance etc. Turned out she found out he had done this before but two others had backed out of the marriage they had all three tons of evidence. I don't think what they call evidence means anything and would have never thought to save them. Can't think of anything else against us.

Please everyone do this for all of us, once you read below you'll understand what I'm talking about. Janelle2002 says it much better than I could. Below her first post is her second post with a link to her thread. Also I beg all of you to post this were ever you can we need as many people as possible to do this thank you so very much in advance.

------------------------------------------------------

Yes, but I have heard of people being hit with misrepresentations for not responding to the first reason of denial and at CSC they just wait until you file again and then bring up then deny the second petition and ask why you were denied the first time. It is a hit or miss situation.

http://www.americanb...uthcheckdam.pdf

http://www.npr.org/2...foreign-spouses

This lady's court case is still pending. She has been trying to get her husband here since 2006. She won at the lower court level and DOS appealed. I have started emailing the Supreme Court telling them to repeal this doctrine, it only hurts U.S. citizens when we are not able to bring our grievances to the courts. They are denying us a constitutional right. You should do the same. Here is what I typed.

The Doctrine of Consular Non-Reviewability deprives U.S. citizens of one of their main Constitutional rights, the right to petition their government for redress of grievances. Lengthy, unnecessary delays and the denial of a visa for the spouse of a U.S. citizen directly affect the U.S. citizen. In everyday life this is called cause and effect. Every day, thousands of U.S. citizens are forcibly separated from their spouses and even children during this process of legally petitioning for their family members to join them in the U.S.

The Doctrine of Consular Non-Reviewability takes away the option of redressing the grievance of a U.S. citizen, especially for an individual who is unable to move abroad due to certain hardships.

All Visa petitions pass through the hands of humans, which creates countless opportunity for human error. Chances of Visa problems increase when Visa workers are burnt out, biased, discriminatory and so on. Human factors like these exponentially increase chances for losing, misplacing, or misinterpreting critical Visa paperwork. Consulates abroad are denying applicants mainly under two categories, non-bona fide relationship and misrepresentation. They understand these two categories are hard to overcome and there is no recourse.

Current laws protect the USCIS, DOS and our Consulates abroad, but these same laws fail to provide necessary protections to the U.S. citizens who are currently struggling or stuck in the legal immigration system. Every day, these struggling and stuck U.S. citizens are unable to receive even the most basic relief or hope from this immigration system. For these reasons, all Americans deserve the right to petition our government to promptly and fairly address these major and tortuous Visa issues

Please repeal the Doctrine of Consular Non-Reviewability.

My reply; My heart just sank when I read this, I'll send an e-mail/letter or both as soon as I can catch my breath.

If I can't be with my husband I know I will just die, I wont take my life but as is it's difficult to eat and sleep, this with some hope. With out hope, it would be the end of me. :(

Please, post it everyone. People should be emailing the Supreme Court every single day saying they support this woman's case. A win for her will be a win for us if we need to use the courts in the future to insure our spouses receive a fair chance to live in our nation with us. I also have a post going on in Hot Topics about this.

http://www.visajourn...-6#entry7496063

No one government entity should be above the law. How can we call our nation a nation built on democracy when we cannot petition our government? Isn't this what the courts were made for?

I agree but we are in their hands they are our mommy and we are the babies. I agree there should be full disclosure of what they/we are being accused of but most of all they need to be held accountable for their actions and stripped of the power they have over us. No one should have this much power all by themselves in our personal lives no one.

I agree if our Congress person/Senator/Representiative can't help us then who can? What happend with the persuit of happiness we were promised?

It makes perfect sense to me why you wouldn't have as much evidence as other people, if these are your circumstances. That does not by any means make you and your husband fraudsters. The amount of love and support you give to all of us on this forum---people you've never even met---shows what a tremendous person you are. I can only imagine the love you have for your husband, and him for you.

Skype has always been frustrating to me when it deletes old messages and calls that way. This link might be helpful to you, it tells you how to change your Skype settings so that the messages and calls do not automatically delete. https://support.skype.com/en/faq/FA392/where-can-i-find-my-conversation-history-in-skype-for-windows-desktop-and-what-can-i-do-with-it

And for Yahoo, did you guys send emails or only talk in instant message? If you were using Yahoo and sending emails they should all just still be in your account unless they were deleted. If you have an old Yahoo email account that you can't retrieve because of forgetting the username/password, you can contact Yahoo directly and they will help you with this. I thought I had lost an old email address with them and tried to get it back last summer and they were very helpful and allowed me the old account back.

Even if you don't have any old emails, maybe now is a good time for you and your husband to start sending emails to each other. Not even anything long, just a few "thinking of you, I did this or that today and wished you were here, etc." whatever you guys would say to each other.

I'm so sorry you might have to start the whole process over. That's just so unbelievably unfair. At least if you do have to, you'll have time to gather lots of evidence that meets their criteria (whatever that happens to be).

Since you guys don't have any pictures together, why not take screenshots of your Skype calls? Skype even has the option to take photos within the program and save them. I don't know if this captures both parties though, I think it might only take a picture of the person you are talking to, and not include your little box in the corner. Just a thought, maybe if you take screenshots where you can see both of your call windows and each other's faces this would count as some sort of photographic evidence.
