Separation and citizenship

I'm currently at the fingerprinting stage of my citizenship process. Unfortunately, my marriage is going downhill fast. I've been avoiding taking the plunge to file for a separation and divorce for emotional/logistical reasons but at this point, I think it's worth postponing since I read on the USCIS page that the separation process will render me ineligible for citizenship, with some exceptions. BTW, I'm at the 3-year mark, not 5. Anyway, these are the basic particulars and I wanted to know if anybody has been in a similar situation...on the verge of separating or divorcing AND in the middle of the citizenship process. Did you wait? When did you file for separation? Basically, when is it "safe"? Any opinion appreciated! thanks!!!

Based on my husband's experience it took him about 5 months to complete the whole process to be a citizen.

My husband was also married to an American Citizen. He had 10 years green card and he was in the 2nd years mark when he divorce his ex-wife. He was waiting until he's eligible to apply for a citizenship. and 90 days before the 5th anniversary of his 10 years green card, he filed for a citizenship and Thank God he became a US citizen last Sept 2014. The whole process was very easy and pretty smooth. IO didn't ask a lot of question regarding his previous marriage.

My suggestion is just follow your heart and listen what it says. You can always be a citizen after 5 years as long as you keep your criminal record clean.

but if you still want to go though the whole process to be a citizen while in the mean time you are having a lot of issue with your partner and think about a separation, you better give your self little bit more time & patient and stop thinking about divorce for at least in the next 5 months.

Sorry, i cannot help that much.

Good luck!!

hi

so sorry to hear this, but if you separate or divorce you can't continue the citizenship process

at the interview you will have to prove again that you are still married and it is a bona fide marriage, you will have to present evidence of a good faith marriage

not only you still have to be together at the interview stage but at the Oath Ceremony as well as you are becoming a USC based on the 3 year rule of being married to a USC

one of the requirement to be naturalized under the 3 years rule, you need to be living with your usc spouse which you don't meet. I would withdraw my application if you see noway you can continue this marriage
