Just got my checklist email the day after my documents were reviewed. Actually impressed by the NVc's speed with this one.

My worry is now that if i make the changes but because I don't have the old documents i may make a mistake with something else and cause another :/

Does anyone have an example of a statement for my wife explaining why she's doesn't have 2013 tax returns as she was a student that year?

I am the USC. Although I am not a student, I live abroad with the beneficiary and I have no income. Here is what I did. We got our CC without checklist.

  • I printed off and supplied Excerpt from IRS tax law, Publication 554, table 1-1.2013 filing requirements, appropriately highlighted
  • I included my tax filings for the foreign country showing that I did not claim sufficient income in the foreign country/currency to file US taxes.
  • I back-filed my taxes with the US IRS for the last 3 years and included copies of those as well as included a written explanation from me stating that due to recently filing US taxes to be in good standing that there were not any tax transcripts to include, but if I had them at the time of the interview that I would provide them as well as copies. In my explanation I also made mention why I was not earning income.
  • For good measure, I contacted a US based tax preparer and asked them for a signed letter on their letterhead stating that i did not need to file taxes due to not meeting the filing requirements.

What I included could be much more than what they need, but I wanted to get as much included as possible and give us a better chance of not getting a checklist over something like that. Hope that helps!

How far out was your interview scheduled for?

Met in 2010 on a forum for a mutual interest. Became friends.
2011: Realized we needed to evaluate our status as friends when we realized we were talking about raising children together.

2011/2012: Decided we were a couple sometime in, but no possibility of being together due to being same sex couple.

June 26, 2013: DOMA overturned. American married couples ALL have the same federal rights at last! We can be a family!

June-September, 2013: Discussion about being together begins.

November 13, 2013: Meet in person to see if this could work. It's perfect. We plan to elope to Boston, MA.

March 13, 2014 Married!

May 9, 2014: Petition mailed to USCIS

May 12, 2014: NOA1.
October 27, 2014: NOA2. (5 months, 2 weeks, 1 day after NOA1)
October 31, 2014: USCIS ships file to NVC (five days after NOA2) Happy Halloween for us!

November 18, 2014: NVC receives our case (22 days after NOA2)

December 17, 2014: NVC generates case number (50 days after NOA2)

December 19, 2014: Receive AOS bill, DS-261. Submit DS-261 (52 days after NOA2)

December 20, 2014: Pay AOS Fee

January 7, 2015: Receive, pay IV Fee

January 10, 2015: Complete DS-260

January 11, 2015: Send AOS package and Civil Documents
March 23, 2015: Case Complete at NVC. (70 days from when they received docs to CC)

Her case number is 5 number after my wife case but somehow i was able to access to fill out ds-261 and pay AOS fee already while my wife's case is still showing error message when i log in. Is it normal? Maybe they forgot to enter my case information into the system? Should i just call them on monday. Im so upset right now. :(
