  • got a question about I 864

my husband just sent me a copy of our completed form to ask that I double check it for accuracy.

upon reading 'how to fill out this form' I am now thinking he needs to acknowledge his former wife as a dependent in Part 5: Sponsor's Household size as he still pays alimony to her. looking at his tax summaries, it shows he pays alimony.

so, knowing this, is she included in Part 5, number 5 "if you have any other dependents" ??????

If so, then this is how our Part 5 section should look

1. 1 (me)

2. 1 (him)

3. 0 (he is only married to me (thankfully :dancing:) and I am included in number 1)

4. 0 (his children are over 21)

5. 1 (his ex that he pays alimony too)

6. 0 (no prior sponsors)

7. 0 (no one else's income is being combined)

8. 3 (me, him and the ex)

Anyone with a similar case.....is this what you did??

Today i received a hard copy welcome letter in my mail box. It is dated 6th Jan. My take, if i wasn't proactive by contacting NVC i guess this is the date i would be receiving the case number :goofy: . I am far ahead coz we called them. Be smart and call call call. We are mailing our AOS/IV package today. We have two petitions.

How did you get your IV invoiced so quickly? Did you call to have them review DS261? If so at what point. Thanks.

update...

i just looked at his tax summary print outs and she is not listed as a dependent because she does not live in his house...but it does show he pays alimony. when i read what constitutes a dependent on p5 of the instructions, it indicates that 'only list those you claimed as dependents on your income taxes' be counted in #5 of Part 5.

I'm confused and want NO checklists...

your help is appreciated

you are right. part 5 should look like as you entered. your husband should acknowledge his former wife as dependent in part 5. your household size would be 3. If possible, attach a document to prove the alimony along with i-864. Mention about this proof in a cover letter.

Others, please correct me if i'm wrong.

update...

I hope someone else on this forum with personal experience can verify for you. If not you can always call NVC.

It is my interpretation of the instructions that you would NOT include the ex wife. Paying alimony does not make her a dependent and he is not claiming her on the federal tax return.

I hope someone else on this forum with personal experience can verify for you. If not you can always call NVC.

It is my interpretation of the instructions that you would NOT include the ex wife. Paying alimony does not make her a dependent and he is not claiming her on the federal tax return.

I've l,ooked over his tax summaries, which are very different than mine in Canada. It appears she is NOT a dependent in his taxes but almost like a payee, her ssn is listed and the amount she is given and is categorized under "adjustments to income". Not being tax savy at all, it makes sense to me that she is just merely that....a payee. His payments to her are reflected in his gross income calculations, so I suspect that she does NOT need to be counted.

Still want other opinions,,,,thanks!

In that case, you don't have to include her in your household size.

But, please confirm with NVC or from others who have gone through this scenario.

Good thing is that rep is telling, they expect the review soon. Seem they still try to stick to the 60 days SLA.

While I saw some Dec9 with CC, but NVC is really random and unpredictable. I even saw a few in FB having CC at their 59th and 60th day.

My scan date is also the 8th, that will be awesome if they are done by the end of the week!!!! I was thinking I would wait until Monday to call so that they wouldn't say anything about the weather :) good luck I hope we both have CC by Friday!!!!!

So, we just sent our AOS & IV packages on 1/29. They arrived on 1/30. This afternoon I got this checklist. I called NVC and they told me they didn't have my documents yet, but my package arrived is now in their mail room as of today and is yet to be scanned in...




We reviewed the documents you submitted to us. This letter has a list of documents that are missing or

that need additional information. Please review the instructions and send us the required information. If

you do not provide this information, it will delay your immigrant visa interview.

______10 - SWEDEN POLICE CERTIFICATE:______________________________


A police certificate criminal record abstract (Utdrag belastningsregistret - utlandsändamål) is a record

taken from the National Police Board and is issued to all persons upon application. Application forms

(including forms in English) for a Swedish national crime record extract (Form RPS 442.1) can be

downloaded from the Swedish Police webpage: www.polisen.se or obtained from the local police

station. Complete instructions regarding payment and the charge for return postage can be found on the

form. A copy of the passport or birth certificate must be included with the application. The police

certificate will not list any criminal offense which occurred more than ten years prior to the certificate

request. Time for processing the application is approximately 2 weeks. The National Police Board will
