URGENT- Advanced Parole

I saw a related thread made regarding this issue but decided on making a new one so as to not hijack that thread.

I received a call last night that my mother was admitted to intensive care due to Pneumonia and Heart Failure and is hooked to a ventilator. I would like to go back and take care of her. I currently have the EAD/AP combo card but I do not want to risk not being able to come back in on a technicality.

I got married Jan 2014 but waited until August 2014 to file for adjustment of status so we could save up for it. There is a clause on the AP that worries me since I was out of status for a bit and do not want this used against me when I come back. My worries about being out of status before applying for AOS was mostly because of what I read on a lawyers website:

"According to the USCIS, the combined EAD and Advanced Parole card allows an applicant for adjustment of status to travel abroad and return to the U.S. without abandoning his or her pending adjustment of status application. However, for people who have been out of status before they filed adjustment of status, travelling on Advanced Parole could have severe consequences, including being stopped at the airport and not being allowed to return to the U.S., being found "inadmissible", having their adjustment of status denied, and/or being subject to a 3/10 year bar."

That would make me nervous for leaving the country and entering again for sure.

I would suggest contacting your local USCIS office, maybe get an info pass to address this so you have definitive answers.

That's a whole new spin on your case. I would do as Hank has suggested. If only you had your GC in hand. Isn't Monday morning quarterbacking wonderful. It answers the "If only I had . . . "

Filed: Timeline

  • Yes go to your local office and take the cable or however U got

  • word , docrors statement etc talk to an officer & get the pros & cons

before leaving...I know someone who traveled to dads funeral, got only

21 days to return did so in 14 days thru Miami with no prob. but things

changes & some CBP act like gods so fine tune this before leaving

I've scheduled an INFOPASS appointment. I hope we can sort this asap so I can see my Mom soon. Thank you all.

Things got worse now and I cant wait till the 9th. I will go to USCIS Raleigh tomorrow morning in the hopes that someone will talk to me. My mom went into cardiac arrest this afternoon. They were able to revive her but we are being told to prepare ourselves and asked us what to do in case she arrests again. I really hope USCIS can accommodate me tomorrow.
