Hello, VJ family member.

First of all I would like to say big thank you to everyone who help me with their knowledge and precious time. I have received my K-1 visa and arrived in USA two weeks ago.

I am in process of applying for adjustment of status (AOS). I have few questions in this process. If anybody can help me out here please.

Q.1 I have seen on USCIS website that if i apply for employment authorization (I-765), I do not have to pay extra fees for this. But I have also seen that I can apply this online as well which is quicker way. But if I apply online do I have to pay fees or that can be consider as I am applying all together with AOS.

Q.2 My wife is medical student and does not have any earning. So i need to reply on her family member as sponsor. Now this family member is her Uncle (Her father's brother). Do I have to file I-864A to show relation between main sponsor and her? or DO i have to file two I-864A to show relation between her and her father and her father and uncle.

If anybody can please have a look and share some knowledge here, that would be more than anything.

no it is sent to the NVC when file for consular processing to be sent to the country of origin and your wife would have to pay the i864

when you are adjusting status in the US the whole packet is mailed, with the i485

your wife has to file the i864 as sponsor, her uncle will file another i864 as her joint sponsor, you don't fill out the i864, the petitioner does. even if she puts $0 as income, she will attach a letter explaining why she doesn't have to pay taxes

1.) You are not eligible to e-file the I-765. You must send the form with your I-485 or after. The fee is waived with a pending I-485.

EAD Applicants Who Have Filed for Adjustment of Status:

(c )(9) Adjustment applicant who are not required to pay a fee for Form I-765.

2.) An uncle is not a qualifying relation for filing an I-864A. The uncle would file his own separate I-864 as a joint sponsor, not a household member. Read the I-864 form instructions for all the details and requirements > http://www.uscis.gov/sites/default/files/files/form/i-864instr.pdf

Who May Be Considered a "Household Member" for Purposes of This Form?
For purposes of this form, a "household member" is:

A relative who has the same principal residence as the
sponsor and is related to the sponsor as a spouse, adult
child, parent, or sibling;
