You may need to check if any application has been filed for you. I thought the I-212, was the waiver that says you are able to apply for a immigrant visa, and it was not a visa.

Since you left, you still have a ten year ban, and will not be able to return until after that date.

Did you leave before DACA was in effect?

An alien who is inadmissible under section 212(a)(9) A or C of the Immigration and Nationality Act (INA) files Form I-212 to obtain "consent to reapply for admission" that is required before the alien can lawfully return to the United States. "Consent to reapply" is also called "permission to reapply."

The waiver allows you to apply for a petition for lawful admission in the United States. It is not a visa. It says you are approved to apply for a petition, but cannot return until after your ban is complete.

Ok, that is why we are confused, you were referencing the waiver as if it was the application for a visa, and since you received the waiver that you were now waiting on the interview.

That is why there were questions about the visa and any approval of a visa.

Now you have to serve your ten year ban, and if visa is approved, you can re-enter.

You need two waivers:

(i) An I-212 waiver seeking permission to re-enter after being deported.

(ii) An I-601 waiver of your illegal presence.

Without both, you cannot receive a visa. It's also not clear on what basis you have been able to be the beneficiary of an I-130, either. Has one even been filed / approved?

OP do U have an I 130 approved, did your g/mother adopted U

while raising you, and what are U being told by this atty, did you

go thru NVC yet? These things have to happen for a visa to

be approved and issued...saying your waiver was approved gave

the impression you already did consular thing and is awaiting

final interview after waiver approval....ask the atty about the steps

since he is a high priced guy, he should know what he is doing..good
