As you can see from my timeline, I got the K-1 (yeah!) and got here and got married (double yeah!). We also submitted everything we thought was required for AoS but got the dreaded RFE yesterday and I'm very confused.

With the I-864 we sent in a copy of my wife's contract and a recent paystub to prove her current income which is above the 125% of the poverty level for a household of 2 as per the I-864P. However, in the RFE we were sent, not only does it ask for supporting tax documents (we didn't submit her W-2 which I didn't even think we had to, but that's my bad) but it also claims that the supporting evidence suggests that she isn't earning enough and that we need to find a co-sponsor or submit evidence of sufficient assets. The latter is a non-starter.

I think they may have completely ignored the contract and paystub (although I would not have been surprised to see them ask for further paystubs in an RFE, but not disregard them completely) and simply gone on the amount on her tax return last year which, admittedly, wasn't enough to fulfill the criteria. I thought it was supposed to be judged on current income, though, which is more than enough!

We can potentially ask her father to be a co-sponsor but as he is self-employed, I can see that being a pain!

I'm very disheartened, especially as an immigration attorney friend of ours couldn't understand why they have said my wife isn't earning enough as she is! For anyone who might have had a similar experience, is it worth me calling the USCIS customer service or will that be pointless and should we just try and sort out the co-sponsor thing now?

First let me scold you for not reading the instructions to the form. Bottom of page 7.

You must provide either an Internal Revenue Service (IRS) transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year.

Without seeing a tax return, they stop considering her qualifications. You failed on #1 requirement, so it is like any contract or pay stubs (optional items) don't exist. Won't look at them until you get the required part in. Therefore she makes no money, therefore you may need a joint sponsor. It is is the same general RFE verbiage that everybody without a proper tax return gets.

Fix the missing tax return and everything else they said goes away. They will look at her other proofs and see she qualifies.

Pick one:

1) A tax return transcript ordered from the IRS.

- or -

2) A photocopy of the entire tax return including all forms and schedules PLUS a photocopy of her W2. Those are partners. A W2 alone doesn't count.

And you can read that in the instructions on page 8.

Normally I would agree with you but we did send in her tax transcript for 2014 with the application - the same one we obtained and used for my interview in London. Which is why I was confused about the W2 as well as I thought you only sent that in if you chose to send in a photocopy of the actual tax return as you said. Edited by swji89

Normally I would agree with you but we did send in her tax transcript for 2014 with the application - the same one we obtained and used for my interview in London. Yes the tax return transcript. Exactly, it's all a bit bizarre. However, as the RFE letter says we need to send in the information or be denied, I guess we are going to have to come up with a co-sponsor and also send in a photocopy of her whole tax return plus W2 because they are asking for all the supporting tax documents, despite us sending the tax return transcript. You can see why I'm perplexed!

Hello, I've just received the instructions letter (giving the London website and the approved I-I129F)

Clicked on the first page to fill out the info online I'm guessing this is the right thing to do, but it's asking me for a passport book number, again guessing I don't have to fill this in.

Scrap my last question, I found out the answer.

Do have a few more though, should I be filling out the DS-160?

On the instructions it says this is step 1 so have completed most of it but it's asking me about documented vaccinations, I do not have these yet but will have them by the time everything goes through, so do I mark this as yes?

It is also asking if I have ever been arrested or convicted, got warned about an egg throwing incident in 1998 but was never arrested or convicted, do I answer yes or no to this?

And finally i've been in the same job for over 13 years do I need to provide duplicate information on previous work, as all supplied on the current employment screen?
