Hi all,

(First question on here, please forgive if this is the wrong forum)

I'm currently in the US with an L-1 Visa which expires on March 15. However, my girlfriend and now my fiancé (US citizen), are getting married this month. Right after, we want to submit the I-130 and I-485 forms.

However, since I have to travel *a lot* how or what do I need to do? It is my understanding that I need to submit an I-131 for being "allowed" to travel. From reading, the I-131 seems to be very restrictive. My business demands me to be flexible and travel to London, Singapore, Vietnam, Switzerland, Germany, etc. within a 2-3 weeks notice.

So in short:

1) As an L1-visa holder is the I-130 and I-485 the right forms to submit? Can we submit them together?

2) If I need to travel throughout the year many times many times sporadically, how to go about this?

Last but not least, should we do this ourselves or simply get an immigration service to do this for us?

1. Yes. Yes. Be aware there are more forms. Read the Guides. The I-130 and I-485 are not the only forms you will need.

2. The I-131. AP is not as restrictive as you interpreted. You can use AP to travel for any purpose.

Thank you for your answer. I'm aware that there are more forms to I-130 and I-485.

Regarding I-131, do you know if I can simply get it the form filled for many travel dates or do I have to file the form for each travel date. Something, which will be highly troublesome for me.

There are no date restrictions on AP. You can use it as many times as you want.

If that is actually true, that is awesome news. So, in short, I file I-130, I-131 and I-485 all at the same time and then I'm allowed to travel back and forth as many times as I want? In other words, I will have to wait for travelling until I-131 has been approved?

Sorry for the re-questions, but I just want to make sure ;-)

It will take time to get AP so there will be a period when you can not travel.

Yeah I've guessed so. If this is around 60 - 90 days I can deal with it. However, if this is for longer I will have a problem (I'm a business owner and need to visit customers worldwide). Is there an alternative?

You can travel anytime you want. If you leave without the I-131 approved and have AP in your hands, then you are deemed to have abandoned AOS.

It takes about 90 days. If you need it before that, then ask for an expedite.
