Guys,

I need your help on this.I am on CR1 Visa and will be applying for Removal of Conditions in September this year. However, I have a question related on filing my taxes. I will be filing my US taxes as "Married filing seperately" - because of ONE single reason, My wife has a tonnes of federal student loans and herpayments are based on Income Based Repayment plan. So if we both add our income and file together, her Adjusted Gross Income (AGI) would be a lot and then the repayments would go up. Well let me be get this very simple. She is a Resident Doctor and we live in a crazy expensive city. So we will not be joining our incomes for filing taxes for the reason posted above.

That being said, we both are very happy in our relationship and tonnes of other proofs of our relationship, both financial andd others.

The paperwork that I have been collecting so far since I entered on CR1 is the following

1. Insurance Policy - My wife is added as a beneficiary on it. Its close to 500k

2. Rental Agreement - We have a rental agreements on our name

3. Joint Bank Accounts - We do joint banking a lot

4. Driver's License of both have the same address

5. Health Insurance Policy - She is added onto my employers health insurance plan and I have tonnes of paperwork for it

6. Pictures -tonnes and tonnes of it of our vacations in Hawai, Germany, India, Maldives, Canada etc etc

Also some background info, I entered US on CR1 in Dec 2013, but was not issued my SSN until mid Jan 2014. Therefore on my wife filed taxes for 2013 again as Married filing Seperately in late Jan 2014, but she did mention me as her spouse and my SSN on her return.

So if we file again as MFS for the tax year 2014. would that matter in ROC later this year.

Inputs much appreciated.

Doesn't matter if you file MFS or MFJ, as long as you both file as married (instead of single), you're good to go :thumbs: Lots of married people decide to do MFS for one reason or another, doesn't make them any less married :no:

and Saylin - A personal thank you to you! I hope you remember me. Appreciate all your help during the CR1 while I was back in Canada, my FNU issues, my SSN issues, my Canadian citizenship and now time to get ready for ROC:)
