Got a Rfe today stating need more evidence GRRRRR no idea why or really what they want. it says form G325-a I know for a fact i summited one for both of us. Now they need another. also it say on the sheet need to apply for waiver for mulitiple fiance filings. ???? i have only filed for 1 fiance but this is the second time i had to file for her, the first time it got canceled at the embassy.

I dont have a clue on what to do. i am so pissed i cant even see straight. this is the only post i will post for advice after that if Visa cant help me I am going to cancel the petition I cant stand this agonizing wait been almost 2 year since we started all this #######. Thank you sorry for the rant

Sometimes evidence gets lost. It's very frustrating but it does happen. So perhaps that's the issue with the G325a. Make sure you didn't submit the G325 by mistake, it's a different form.

Not sure about the waiver someone else might be able to help with that. Why was the original petition cancelled?

Immigration Timeline

 

June 2013: Met whilst working at a summer camp in Michigan

November 1st 2014: I-129f submitted for K1 visa

February 24th 2015: Visa in hand!

February 26th 2015: POE at Las Vegas airport, then onwards to Oregon! 

March 6th 2015: Marriage (with a "real" wedding to follow next year on 7/6/2016)

March 9th 2015: AOS, EAD & AP submitted

September 22nd 2015: Interview

January 14th 2016: Two year Green card received -phew!

ROC

August 8th 2017: 90 day window begins! ROC time!

September 28th 2017: Biometric Appointment in Portland, OR

March 5th 2018: Case received by local office

August 18th 2018: 18 month extension letter mailed

December 2018: Case moved to another office

February 2019: I was emailed that I was approved and my card was in production the same day of my N400 interview 😂

N400

August 8th 2018: Window opens to submit naturalization application

August 13th 2018: N400 Application submitted online 

August 14th 2018: NOA1

September 6th 2018: Biometrics

February 6th 2019: Interview Date! APPROVED!

February 6th 2019: I was asked to return later the same day for my Oath Ceremony! :dance:

I think from what I recall you need to file a waiver if you file again within 2 years of your first petition. Perhaps that is what the RFE is referring to. As to the G325A, yup, i bet they lost it. This stuff can make you crazy can't it!

Send the evidence with a detailed letter stating its the same individual you have petition

a new petition does not make old issues of denials go away, but that may take care of

having to file a waiver....rant but you will have to provide info to help the situation, they

make lots of mistakes & lose stuff in the process

If it was less than 2 years since you filed the last approved petition, then you needed to include a waiver.

From the I-129F instructions >

2. What Filing Limitations Does IMBRA Place on K-1 Nonimmigrant Petitioners?

You must apply for a filing limitations waiver if any of the following apply:

a. You have previously filed K-1 petitions for two or more beneficiaries; or

b. You previously had a K-1 petition approved and less than 2 years have passed since the filing date of such previously
approved petition.


To request a waiver, submit a written request with this petition accompanied by documentation supporting your claim
to the waiver.

Umm... is your beneficiary Filipino? If so, there is no divorce in the Philippines, it's illegal. So there may lie your issue.

I know it must be frustrating, but this is the time you have to be totally alert.

Situation is bit confusing, but you need to figure out clearly how you are going to

respond to the RFE.

From what I've seen on USCIS rejection site, it looks like if you do not satisfactorily

reply to the RFE twice, then the case gets rejected automatically.

So think through and check back with VJ site, and prepare to send the

accurate response back the first time.

The immediate question that comes to my mind is - Did you submit the G-325A initially or the G325 ?

Filing twice is filing twice, doesn't matter that it is the same person.

Get that handled and soon you will be approved :thumbs:

Don't give up! We had same RFE asking for same thing and we were like WTH? That made me cry out loud. My fiancé did not know what to do if he sent incorrect documents or what.... But we thought maybe it got lost somewhere and sent the same thing they asked for. After being on RFE status for frigging long time, we got our NOA2 finally! It's frustrating how USCIS is sometimes but just give them what they ask for and you will be fine.
