Sandra sent me a private email and explained how the system works. I respect her advice.

At this point, I see that the USC has 3 options:

1. Go ahead and file the AOS.

2. Send them back.

3. Do nothing and wait until they are illegal.

I have no control over any of this, so it is best if I close this thread.

She needs to decide what she wants to do. I don't see any VAWA here so the only way her and the child can get a green card is through him. While a joint sponsor is a possibility there is still the fee for the filings. The suggestion of using a CC to pay for the AOS seems slim to none since they can't even pay rent.

If she wants to stay in the US with him she will need to find out where his money is going and help him with any financial issues he has so they can first survive and have a place to live, food on the table, and clothes on their backs. Then they can worry about the AOS.

If she wants out of the situation then she can contact the embassy and request assistance with returning home.

I really don't see what an attorney can do for them.

She is already illegally present in the US and accruing overstay. If she crosses ICE's radar (unlikely, but possible) she could be detained and - possibly - deported.

The only option the USC has is 1. Other than what is being done now, nothing.

Can not send them back and they are over stayed now anyway.
