Today I got 2 mails....

one is I-797 Notice of Action which states that notice type: receipt notice and case type I-130 Immigrant petition for relative and receipt number...etc.

The second mail is the I-485 package I mailed out at the same time I mail I-130 package. It got all returned back and it has 2 paper states I-797C notice type :Rejection notice. It says "the application/petition you filed along with any fee you submitted is being returned to you for the following reasons: based on the information you provide, your priority date could not be established. Please resubmit your application with the proper documentation to the address on the bottom of this notice.

the following documents may be provided:your orginal form I-130 if you are filling concurrently or your original form I-360 if you are filling concurrently or a copy of your form I-797 (notice of action) if you petition gas already been filed/approved or other evidence that an immigration visa petition has been filed/approved on your behalf.

On the second paper, the same, its I-797C notice type: rejection notice. Case type:I-131 Application for travel document It states the application/petition you filed along with any fee you submitted is being returned to you for the following reasons:

The entire application package you filed along with any fees you submitted is being returned to your for the following reasons: The priciple application could not be accepted for the reasons specified on the related notice of action (form I-797) Therefore the processing of all riding application can not continue.

I am freaking out now....What did I do wrong and what should I do now??? Please help!!!

It's kind of hard to discern everything in your post since it's all a bit jumbled up, but from what I can gather your AOS application was denied because you don't have the I-130 documentation with it which is weird because you did send it in, right? Maybe if you posted the entire contents of your rejection letters it would be a bit clearer.

Sorry for my poor gramma.....I am here on F-1 student visa.....let me explain again.....today I received 2 mails

O it wasn't a comment on your grammar, it was just that I wasn't sure if I was reading all the notices correctly cause they were all kind of mixed in together :) I thought that if you didn't come here on a marriage visa but were married to at USC and wanted to do AOS that filing I-485 with an I-130 is what you are supposed to do...but I have no experience in this so I'm sure someone much more experienced can come along and explain what the deal is. I hope you get it worked out!

did you submit the marriage certificate and USC birth certificate and indicated that you are adjusting based on marriage to a USC ? as in immediate relative?

Check the form I-485 for any errors and re-send with marriage certificate and USC birth certificate indicating that it is immediate relative and hence the priority date is current!! :thumbs:

applications on file - dec 21 (day 1)

check cashed - dec 23 (day 3)

NOA for 485,130 - dec 26 (day 6)

all three touched - dec 27 (day 7)

biometrics letter - dec 30 (day 10)

all three touched - jan 5 2007 (day 16)

I-130 and I-765 touched - jan 10 2007 (day 21) - HUH? What about 485???

biometrics appt - jan 11 2007 (day 22) - DONE (went early - got done in 5 mins!!)

Yes, I married to a USC. Am I supposed to include I-797 notice of action and I-130 form in my I-485 package? (according to what I read on the paper) I did put a photocopy of marriage certificate and birth certificates in my I-485 package!!!

I am so lost now~~~~

I think your biggest problem is you sent things in two different packages.

Ah ha, I thought things weren't making a lot of sense...

hmmm.......I mailed out I-485 package with I-131 (AP),-765 (EAD) and supporting documents to Chicago office~~and also mailed out I-130 petition with all supporting documents for relative to Nebraska office. In my I-485 package, I didnt include I-130 form though....maybe thats what they want or what? this is so frustrating~~~

Yeah, the reason you got rejected is because you needed to have included the I-130 in with your I-485, etc, and mailed them all to the Chicago office. Without the I130 in there they will think you aren't eligible for AOS since you don't have an immigrant petition already approved for you. The government isn't that good at communicating so who knows when or if your I-130 from Nebraska will ever get linked up with anything! Here is the guide for filing, go through it and resubmit your package :)

Just as a note you may want to consult an immigration attorney to be sure you file everything correctly this time, or at least consult with one :)

Thanks for helping me out....I freaked out when I saw "REJECTION NOTICE" and I felt my world is going to end!!!

Really not sure, I'm not an expert on filing AOS this way since James came in on a K1, so I'm afraid I can't be much more help! :(

Now you have proof that you have filed I-130, i.e. the I-797C, you can refile the I-485 etc and include a copy of the I-130 NOA with that to proof you have a pending application for immigrant visa number. Everything should be OK, but next time(!) file everything in the same envelope.
