k1 visa with self employed proof ( london embassy only)

hello, I am waiting for the fist part of the process to get through but in the meantime I am gathering my info for the next steps. I am self employed and just filed my taxes for 2014. I heard you might need a tax transcript at the london embassy, not sure if this is true or not. For the past year I made above the income requirement, but the previous years before I was under the limit. I have also been told that since I was paid in all cash ( with no forms) I might not be able to get a transcript ( hr block people mentioned that). Has anyone else had an issue with tax transcripts at the London embassy

There is further information in the various guides, but I believe you can also take your bank statements as proof. Although you were paid in cash, I assume you then put the money into a bank account? Demonstrating these transactions may be of use to you.

thanks for the response. yes, I deposited all my earnings into my bank account and have statements for all of last year. I have an immigration attorney putting everything together for my fiances interview ( once the case is approved from texas..seems like it might take a few more months) I also have my tax return already from 2014, but wasnt sure about the tax transcripts or if the tax return print out is acceptable.

London isn't a tough embassy and generally just want one type of proof... have a read through the guides but I am pretty sure bank statements will help you here.

. now if texas will speed things up that would be good haha. I'm sure everyone will agree the waiting is the worst part.

Hi there! Sorry, I'm just a bit confused. You just filed your 2014 tax returns and got paid in all cash the whole year? So, you didn't fill out a W9 or anything of the sort for your employer/client? And H&R block said you might not be able to get a transcript because of it?

I'm self employed, technically. However, I filled out a W9 when I started, get direct deposits from my employer and have physical paystubs so I have that as proof of my income for tax season.

The only concern I have for you is that a cash transaction might be difficult to explain when it comes to the i-134 stage in this. I mean, I could be 100000% wrong, but I haven't seen anyone post about cash transactions. And I hope I am wrong (and I'm sure someone else with more knowledge will weigh in). Maybe, in the future (perhaps for the AOS stage), invoice through PayPal? That way you can show bank deposits that way coming from another account? Just a thought :)

I cant get any invoices through paypal, with the nature of my job. I'm a professional touring musician and we get paid by cash ( most touring musicians do) I know the IRS accepted the tax return and sure were quick about taking the money out of my bank that was due haha. My attorney said That the tax return itself should be fine but a transcript is best. looks like I'll be on the phone with the IRS trying to get a human on the phone

Ah, that makes more sense! I work in entertainment, so I completely understand now. I think you can even order a tax transcript via the IRS website - I believe it's in the guides that Pheebs posted about earlier. Definitely worth checking out - or try and get a human on the phone :) Either way, good luck!

It could be possible that Im checking to early after filing taxes. I'll wait a bit and check the website again if not I'll call. I think I'll have some time with the case going through TSC. its almost at the two month mark .

When did you submit? If you submitted in late 2014, you still have several months to wait as TSC is taking roughly 6+ months to process.

Here's the deal on transcripts vs copy of the actual tax return.

When you file a tax return, the IRS will process it and it will eventually be available in their records to order in transcript form. It doesn't matter if you reported earnings received by check, cash or paid in £, ¥ or chickens. Transcript means they transcribe whatever you filed into a no frills printout of the basic stuff in your return. But it doesn't always happen that quickly. It's tax filing season, so starting to get busy for them.

One year I tried to get a transcript in May and it came back as not available until November. But the delay could have been my return required more looking over because I was supposed to have a penalty (for not paying in during the year and owing thousands at the end). I sent a begging statement instead of the additional penalty.

You will be able to get a transcript, but the question is "When"?

So if you don't have a transcript, the other option is your [Form 1040, Schedule C, Schedule SE, etc] plus [a W2 or 1099.] Perfectly fine. But you don't get those wage reports. Anybody could fill in tax forms showing a lot of income. So the other things showing earnings are to back up what you filled in on the tax return. A transcript comes from the IRS so is authentic without any W2 or 1099 wage statement.

Quite frankly, London is so laid back on K1 support, they may glance at your tax return and not even question the truthfulness of it. Have one additional sponsor just in case.

The problem with being self-employed is what you earn in total doesn't count really because you get to take business expenses off your earnings. So putting $20,000 in the bank, but deducting $5,000 as business expenses on your tax return means you earn $15,000 in the eyes of immigration. That's why a tax transcript is the best proof for someone like yourself with no one employer.

When you adjust status, the Affidavit of Support I-864 is very strict. It won't fly to not have either a transcript, or W2 type wage statements with a photocopy of the actual paper return. Hopefully by that time, your 2014 transcript will be available. Hopefully you will easily have it before your London interview.

I got the first notice on dec 15th, so I'll be looking at a few more months most likely. Thanks for the info. My taxable income passed the minimum requirement. But I'll have sponsors on hand if needed. I'll keep checking in with the IRS to see when my transcript is available. Luckily, I keep hearing the embassy in London is one of the easier ones to go through.
