I guess what's throwing me off is that on the appointment letter it says to submit a 1040 tax form for the most recent year, in otherwords filed taxes of the most recent year.

The most recent year is 2014. Does your dad have all in the info he needs to file taxes? If so I don't see the problem with filing taxes ASAP. I filed mine 3 days ago

Yes, and currently, up until the deadline in April, that is 2013. However, when proving current income, the most recent documentation would be of great help. So, even if you have not filed your 2014 taxes, showing the 2014 1099s to prove how much he earned this year from retirement and SS along with the most recent 2013 tax transcript will cover all your bases for proving income. While current annual income is most important, stable, ongoing income is also something looked at when deciding if the foreign fiance(e) will become a public charge or not.

The thing is my dad listed the income on his I-134 as shown on his 2013 transcript. The salary for this year is actually more.

His last 6 months of bank statements I submitted show every month that the retirement and social security go into his account and I also provided a verification letter from his retirement saying how much he collects every month for life and also a letter from social security retirement stating the same...

Then all the more reason to show the most recent proof of income, yes?

Hi! My fiancé is going to interview for k1 soon and I only have copies of of the 2013 & 2012 w-2 forms for my cosponsor to accompany i34 (printed with tax forms from those dates) and pay stubs along with all other evidence (my cosponsor cannot find originals). Does anyone know if this is sufficient?

I'm afraid that he will get delayed in the process and we just had a baby last month that he is aching to meet.

Many companies now provide the W-2 through a web site where you can save as PDF or print. That implies there is no real hard-copy original and copies are just fine.

I was thinking about this also. I run my own business. How many years back do they want to see of tax returns?

I have not gotten to this point yet as I just sent my K1 Visa last week. But is there a link here with the info you have to have to show them you can support or sponsor someone? thanks

Self-employed can use their tax transcripts as proof of income, taking notice that the amount found on line 22 of the 1040 is the income amount they will look at, which is Total Income. The most recent year is usually what is asked for, but you can provide the last 3 years worth of transcripts, if they will help show you meet the income requirement and have stable, ongoing income amounts.

The I-864 for AOS later will have you list the Total Income from the last 3 years of your taxes. You can read the I-864 instructions for a better grasp on what they are looking for, as most consulates tend to follow those guidelines, even when dealing with the I-134 for a K-1 visa.

Thanks for all the replies. I have asked my co sponsor to give me original copy of w2 for 2014, since he didn't have originals for precious years, but taxes won't be filed by his interview at end of February. I suppose that is ok since (a previous poster stated) they are not due to be filed until April 15th . Do you all agree? Thx

Self employed or running on your company should be looked a differently. I have a lot of tax deductions etc I am able to take legally and the final amount it shows as my income is kinda low. With my Fiancé and her kids coming over so close to filing this years tax I am going to have to totally move deductions around so I make the correct amount. Anyone else that is self employed have experience in this area? Thanks
