10 year GC Approved - APRIL 16th ,2009 - Peggy and Jonathan's......

Still waiting for our cards...Had to file I-90 as they sent them to the wrong address.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

Forget about EAD and AOS for a second ... do you have all your paperwork in order? Have you obsessed over it all the prerequisite number of times?

Feb 25, 26 & 28 - got emails saying that the cases had been transferred to another office, then to my local office, and then just transferred and are being processed

Mar 17 - got email, attached to one case number only, saying that my A number was changed relating to the I-130 filing

Maybe it's just me, or maybe there are just more K1's out there then K3's... But does anyone else get the feeling that the K1 interviews seem to be scheduled much quicker then the K3's??

Hindsight is a bi***, but I know wish I had not gotten married and had filed the K1, much quicker.. :(

I may be wrong (as I heard this from a lawyer-hee hee) but I was told to go for the K1 because it was faster. The reason--when applying for the K3 you apply for citizenship (not up on all the accronyms and proper form names-I-130?) at the same time. The timelines run in conjunction with each other so if there is a slow down in the one application process the other halts too. I think it's if there are issues or slower pace in K3 that the I-130 stops progressing. Not sure if this is accurate, but it is why we chose K1 rather than K3.

K1s are processed faster because there's only one petition to file whereas with K3s you need to first file an I-130 before you can file the I-129F. Both petitions historically have been processed separately until recently where it seems that CSC and VSC upon getting to a K3 applicant's I-129F petition pull the I-130 at the same time and then approve them both the same day. Because of that though, they are starting to retain the approved I-130 because the assumption is that you will enter on a K3 and then AOS after entry rather than go back to your home country and interview for a CR-1/IR-1.

A slowdown on one isn't supposed to affect the other. Riblet's I-130 was approved well before her I-129F.

Not sure why the K1 interviews though seem to take precedence. You would think that it would be in this order of preference:

- CR-1/IR-1

- K3

- K1

But it's the U.S. government so who knows! :D

I too am beginning to wonder about the K3s. I don't see any incentive for Montreal to process them if the CR1/IR1 is just coming down the pike (maybe the solution -- to put less workload on the Consulates -- is the new policy to pull the i-130 if the i-129 was approved at the same time and let people file for AOS in the States). In any case, you can ask your local Congressman to ask the Consulate for a "Status Update". The Consulate is required to respond to the Congressman's request within 30 days. This cannot usher the visa through any faster, but I think that it might but the Consulate on notice that folks are paying attention to waiting times. Funny re: Amarceau's comment! I was just saying to my husband last night, "damn, we should not have gotten married and done the K1!" :P

Great news, congrats

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1
