I have seen when people post complicated situations for friends they often leave out important facts. Best for them to post themselves.

Which country has he sought asylum in already?

ya, see, a proxy marriage might be easily done in some 'muslim' country, where the divorce is even easier, [say I divorce you, three times] but without the marriage being registered with that foreign government, who knows anything? usually an imam at a mosque can handle the registration, but since this is not any 'muslim' topic, i am loathe to burn more brain waves on this, really.

Seems likely he has legal presence in the Caribbean or he could not have got a visa, an Asylum claim without any merit would have serious negative connotations.

He has the misrep issue, did any of the Lawyers mention that?

You could expect a rfe for the divorce certificate.

other immigration lawyer said the best solution go through asylum application and figure out first that what Uscis consider its valid or not. he said future if you get marry without sort out this there will be other crime of polygamy/bigamy . he said your Misrep is justify able but not polygamy. he said if you go through marriage to sort out this issue then they can deport if they dont think its justify but if you go through Asylum application and even they think he get visit visa with Misrep even that they will not deport him as an asylum seeker .long story short he said best way to sort out this issue through asylum application.

He shouldn't even marry now. He needs to get the proxy marriage corrected. The easiest way may involve returning home and divorcing there , then he can worry about marriage to the US person. Your friend has a bad habit a using women for his own personal gain. I am sure he did the proxy marriage for some advantage ( like to say he was married on the tourist visa ) and if he tries to explain he lied on the tourist visa he may face a lifetime ban and never be able to come to the US again, How long has he been in the US ? getting married in the 6 months allowed on a tourist visa is very fishy

this person hits it on the head here, as I know in some countries stating married on the tourist visa application helps as opposed to saying single, he needs to return home resolve the proxy marriage, then I would suggest the US citizen comes and marry him there and then apply for a spouse visa as against him coming bk on tourist to adjust again.

Does seem very odd. First thing he needs to do is sort out his marriage.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
