Sad, Depressed, and disappointed after interview got denial

I've been sad and depressed since last week. My wife interviewed on Jan 16th, 2015. My wife said the interview went well, but in the end the CO gave the white paper 221G. The form stated that the CO believe our relationship is not genuine. I've been contacted my district representative, but does not get much help from them. I even email the Phnom Penh embassy, but seen like they don't let me appeal. They told me my case will send back to CIS. My wife and I dated since 2009 and got married Dec 2012. I don't know what to do now...I read the process online and found that currently what I can do is gather more evidence of our relationship and keep wait until CIS contact me....any advise will be appreciate!!! thanks all...

I am sorry for what has happened but did you submitted picture of you together; travelling itterner, communication proof? If these are the documents you already submitted then what else they need.

Once USCIS receives the file back, one of two things will occur:

  • They will simply reaffirm their original approval of the petition and return to the Embassy for another interview.
  • They will agree with the finding and issue you a Notice of Intent to Revoke (NOIR).

If you receive an NOIR, the notice will specifically state why it is being sent (i.e. why the CO didn't believe your relationship was genuine). You will be given a deadline to submit a rebuttal (usually 30 days). An NOIR rebuttal must specifically rebut the points that were made in the notice itself.

Failure to properly respond to an NOIR will result in the petition being revoked.

A proper response to an NOIR does not guarantee reaffirmation and reaffirmation does not guarantee a visa will ultimately be issued.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I guess there might a reason why the CO feel some suspicious of our case is..my wife passport has been renew last year but I have not updated to DS-260 and her current address also changed which I also not updated yet...other than this 2 things, I am confident that my paper works is good. I'm about to email the NVC to allow me to go back to DS-260 to edit/update those 2 things. Any advise? or should I wait until my case send back to CIS?

Your DS-260 is a done deal submitted nothing NVC can do for you there. Why would a passport rename be suspicious when millions of women change their names and get new passports everyday and peoples change their addresses many times between filing and interview. I am sure that is no reason for a denial of a Visa.

Denials for Immigration Visas based on Marriage has to do with the bonafides of the marriage. What you need to pour over is your evidence and what did the CO look at in your evidence that made them think your relationship wasn't genuine. Sometimes it's things that weren't there and weren't said.

I know I have a friend and the CO said that he could see from their communications that she loved him but that he didn't seem to show much love to her (he the husband was being interviewed). They were denied.

So do you have red flags? Did you ask your wife all questions asked and all her answers? Was she confident in her answers. Just had someone go through interview and their answers weren't confident and matter of fact and CO felt they didn't know what they were talking about they were denied. We aren't their with our spouses so we have to trust they are giving us full account. A CO looks at body language all that and our reactions. How as hears.

They must have provided some hints as to why they think the marriage is real.

Are you guys drastically different in age, education, social/financial status, etc.?

Did she stumble in answering any questions about you that normal wife should have known?

I think digging in deeply into and learning about what made them uncomfortable

is important so that you can find ways to recover.

I have a co-worker from Pakistan, who was denied twice, and finally got approved 3rd time

only because they had a daughter and the (USC) wife pleaded with her (doctor diagnosed)

major depression and suicidal thoughts over possibly having to raise the child alone in US forever.

This took 8 years until he arrived in US. They almost gave up several times, but the

child barely kept it alive.

Yes, in order to sniff out frauds, sometimes legitimate cases are unjustly scrutinized.

This is a very nice couple, but having 8 years apart with major stress of not knowing

if they ever could be together has put a serious gap in their relationship,

and they are working hard now to recover from that emotional damage.

A real marriage will stand the test of time, paper-work & outside forces would

not cause me to get fed up & leave my wife , one sticks thru thick n thin, so just

ride it out dude and gather all you can as proof, seem like more evidences will

be needed, are you post mailing her cards for valentines, Bdays & Easter? try that

tell her keep post stamped envelopes, visit again, take more pictures also with friends

Giving up & ending relationship says the CO was correct in the decision

I think you should get a lawyer at this point. Sorry this happened to you. :((

I read somewhere that lawyers are expensive but it's worth the money in your kind of situations.

I think if you document all of your conversations, pictures and pics with relatives and friends. and if you were to have children and document pregnancy with tests and pics with date stamed pictures.
