Marrying on student visa HELP!!!

He is now living with me in a different state than his school. they had no housing or job to offer him, so he made the decision to come here and live with me and apply to a local school. in the mean time we want to marry.

Ifemi84 as others and I have stated before this is the serious point here. In order to Adjust status your Fiance' has to be in good standing with his student visa. Meaning whatever school sponsored him and allowed for him to come to the US (the reason he interviewed was for XYZ school not the school in your town). So if he came and just left 4 weeks later. Out of status and in serious trouble. Because he has to report to the school that brought him. He can't just choose whatever school he wants.

Within that 4 weeks he moved state.

Unclear as to whether he ever started at the College he signed up for. Or ever had any intention of so doing.

Presumably has not paid the college. They have no doubt reported the situation.

The way I read it is that he is considering going to another College, not that he is.

Obviously needs a good lawyer, I have a feeling this is one of those cases that will not be updated.

Yikes. I may be newish around here but even to me it sounds like you've signed yourself for a whole heap of trouble. Any reason you didn't apply for a fiance visa? That probably would have been a LOT easier (and in the end, much, much cheaper). I echo everyone else here--you need a lawyer. And probably a more plausible story.

Student visas aren't a free pass to go to school anywhere you want.

I suggest you marry him, have him return home directly, and then petition him the legal way, like the rest of us.

Op you and this kind of foolishness is the reason why Nigerians have such a hard time when they are in fact legit. Do you really think that people are so blind not to see right through your plan from the beginning? What you have done is fraud and you will be in a lot of trouble if this is found out. They scrutinized Nigerians and others from high fraud countries very carefully. Meeting someone on facebook and applying for a student visa in order to get around going through the process the correct way will not work. Your fiance needs to return to Nigeria if he is in fact not going to school and follow the process legally. If he in fact remains here illegally, then what, he can not work and will always have to look over his shoulder what kind of life is that????

I used to be an F-1 student even before my fiance and I got engaged. Like I was actually in Colorado attending school when we got engaged, but since we decided to get a Fiance Visa, I had to return to Greece. For one, you are NOT allowed to switch schools like that. On his I-20 it clearly states that he attends "XYZ" college that the Embassy approved him for, instead of the one you somehow wanna take him to. Also, on an F-1 you are not allowed to work off campus, however, you can work as a student hourly (temporary and part time) if you can find a slot. In addition, if he hasn't showed up for orientation at the assigned school they will cancel his I-20 and SEVIS which practically means he is out of status and very illegal right now. As a result he can't adjust his status, even if married, when he is currently OUT of status. When i applied for my Social Security, while I was on an F-1 so I could work on campus for a month, they had to see my I-20 and a note from the college's international student counselor or whatever that verified that i was in good standing.There is a reason there are specific types of Visas.... if this was the plan for the beginning, you guys should have just filed for a fiance or spouse visa.

This will appear highly irregular and will count as fraud. F1 visa holders can't go to any school they want, they go to the school that petitioned for them and was approved by the USEM.

Best course of action is to DESIST.

so your fiance had no immigration intention 4 weeks ago, and suddenly decided to start the immigration progress now? that (very) short turnaround time is a huge red flag IMO.

In addition to all of the other things people have mentioned, the fact that you've known him for 10 years will be a HUGE red flag which, taken with the other circumstances, will be very difficult to overcome.
