Timeline

The AOS ranges from person to person. When I applied for my AOS, I got my AP and the EAD in less then a month after sending in the docs. Other's have waited close to a year to get thiers. All depends on a million things, where you are, how busy, how straigh forward your case is etc.

So there is no exact time limit. It could be weeks or months, just depends...

Oct - Job offer in US

Nov - Received my TN-1 to be authorized to work in the US

Nov - Moved to US

1998-2001

Recieved 2nd, 3rd, 4th, 5th TN

2002

May - Met future wife at arts fest

Nov - Recieved 6th TN

2003

Nov - Recieved 7th TN

Jul - Our Wedding

Aug - Filed for AOS

Sep - Recieved EAD

Sep - Recieved Advanced Parole

2004

Jan - Interview, accepted for Green Card

Feb - Green Card Arrived in mail

2005

Oct - I-751 sent off

2006

Jan - 10 year Green Card accepted

Mar - 10 year Green Card arrived

Oct - Filed N-400 for Naturalization

Nov - Biometrics done

Nov - Just recieved Naturalization Interview date for Jan.

2007

Jan - Naturalization Interview Completed

Feb - Oath Letter recieved

Feb - Oath Ceremony

Feb 21 - Finally a US CITIZEN (yay)

So let me make sure I get this right:

Once I enter the US and get married I submit my EAD, AOS.

EAD - will take approx. 3 months to get and is valid for 3 months

You're confusing the JFK-issue EAD (hardly applicable to Canucks--rather inconvenient and expensive to arrange flights to ensure customs/immigration clearance at JFK) with the plain-jane EAD. The latter (which is the one which takes about 3 months to get) actually has validity for ONE YEAR (from issue date).

AOS- will take approx 6-18 months to get and I can only travel to Canada with an AP, which takes approx. 4-5 months to get. Once I get the AOS, I am then a Conditional Permenant Res., until I have to ask for the restrictions to be remove after the two years are up?

Also, validity of AP is one year (from issue date).

Generally, AP and EAD tend to arrive simultaneously

Actually going through Immigration at JFK from Canada is now impossible as the last Canadian airport that has flights to there (Halifax) now has a PFI station...

I heard that you can get a EAD stamp that is valid for 3 months at the Detroit/Windsor Bridge crossing. Would I still be able to apply for an EAD that is valid for 1 year, even if I have a EAD stamp that will run out after 3 months?

Not quite true, as it IS possible to book a flight from a Canuck airport to Heathrow (or any other major European hub) and then return to JFK--though I covered that case with my comment of "extremely expensive and inconvenient".

Yes. The two are disjoint--as the one-year EAD is part of AOS package, while the other is not.

Not quite true, as it IS possible to book a flight from a Canuck airport to Heathrow (or any other major European hub) and then return to JFK--though I covered that case with my comment of "extremely expensive and inconvenient".

I understand that we need an AP to travel back to our originating country (Canada in my case) but what about travelling outside of the US but not to Canada--for example-for our honeymoon we'd like to go on a cruise. It won't be going anywhere near Canada. Do we need an AP to do that too?

Your AP is not limited to one country. Technically it's the document that lets you re-enter the US. So yes, you need the AP for any travel outside the US.

Be very careful booking a honeymoon prior to having the Advance Parole. You can't apply for the AP until after or with the AOS and you can't apply for the AOS until after you are married. The AP takes approximately 3 months to process after the AOS application is received. If you leave the US without the AP to go anywhere you will be refused re-entry t the US. As well, your AOS application will be considered abandoned meaning you would have to start over from the beginning to get permission to re-enter the US as a spouse of a US citizen. You would have to apply for either a K-3 visa or a CR-1 which would be processed through Canada. You would not be allowed to enter the US to live until you received either one or the other, and it is unlikely you would be allowed to visit. If you went the K-3 route, you would then have to re-apply for the AOS all over again, although you would be allowed to leave and return to the US during the process. Best to wait until you have your AP in hand before you plan on a honeymoon outside of the US - even a cruise which runs the risk of landing somewhere in another country if there is an emergency.

Definitely be carefly planning the honeymoon - Hawaii is okay if you have a direct flight - but I believe that almost any cruise is considered leaving the U.S. because foreign registered cruise ships are considered foreign land.

There was a VJ member that was in the USA on a k1, she used to risk it and travel back to canada with AP, she got stopped and denied entry! So she sat in Canada and commenced the k3. Best of luck

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

And I also remember a VJ member with a Limey K-1 fiance, who wanted to go to Montreal for a honeymoon immediately after the marriage.

I posted that she could do so BEFORE (absurd as it may sound--as the Limey would be able to enter Canada at Montreal, spend a few days there, then go through the PFI) but not AFTER until the Limey received AP.
