Hi gang.....been a while since being on here... gotta few Qs for you guys....I am a US born citizen and i married a filipina which now has her 10 year green card....ok, my 1st Q is: i want to get my step daughter(wife's daughter) to USA, or is it better to let my wife file? we were married in philippines and wife came to USA under the CR1 catagory in 2011.. i've read all over VJ and read post after post...the more i read the more i get confused... can my step daughter get here faster under me filing or let the wifey??? ....2 do we need to file the I-130 or am i overlooking something as to where we don't have to file anything..

10-26-10 NVC recieves our petition

10-27-10 NVC case # assigned..

11-02-10 DS-3032, I-864 Bill received.

11-02-10 AOS Bill paid.

11-09-10 IV Bill recieved

11-09-10 IV Bill paid.

11-15-10 Sent IV and AOS packages seperately via overnight mail.

11-16-10 IV and AOS packages received at NVC at 11:22am ..... Now the wait begins again :(

11-30-10 Both packages entered into NVC's system awaiting review.....

12-07-10 RFE. A simple fix , But i need to wait till replacement page of Ds230 arrives, then overnight the checklist stuff back to NVC.

12-15-10 RFE docs arrived via DHL from Judy...heading to the Post Office to overnight to nvc

12-15-10 Overnighted the RFE checklist docs to NVC

12-16-10 NVC recieves RFE checklist docs

01-07-11 SIF ..... Thank you God...

01-10-11 Case complete, now waiting on the interview date email...

01-24-11 Finally got the interview date. March 1 @8:30am Thank you God. Now i can be at ease

02-04-11 Wife got a letter from USEM in Manila rescheduling her interview... was March 1, now Feb 17 ... ;)

02-07-11 Medical, day 1 of 2 (Passed)

02-08-11 Medical, day 2 (Passed)

02-17-11 Interview.... APPROVED.....Thank you GOD

02-28-11 Visa in hand!!

03-14-11 Departing Manila for her 24 hour flight to me

03-15-11 My baby is HOME!!!

03-21-11 Welcome letter and GC received

You can file i130 for your step-daughter IF you married her mom BEFORE her 18th (daughter's) birthday.

Step-daughter will be under the CR2/IR2 category. Processing time is more or less a year.

Better if u the citizen file an I-130for ur stepdaughter.how old is she?

11-02-10 AOS Bill paid.

11-09-10 IV Bill recieved

11-09-10 IV Bill paid.

let your wife petition her. since she is still green card holder, she can start the petition, hurry the process will be longer if your step daughter will reach 21.

by the time your wife is eligible to apply for US citizenship, let her do so, because once she will be a US citizen it will speed up the process, family of the US citizen don't have to wait for visa coz they are priority in the immigration process.

How old was the stepdaughter when you married her mom?

If she was under 18, then you can petition for her. It will take about a year. Her age will "lock" under CSPA and remain whatever it is when you file the I-130.

If she was 18 or older, then you can not petition for her. An an LPR, her mother can file for her. It will be an F2a case and take 2-3 years. However, her age is not locked until her PD becomes current. She could age out and it could take 7 years.

Best if you can file.

She is under 18 when me and her mom got married. She's just 19 right now. And we got married last 2009. We sent the petition and I will be petition her since she's under 18 before the marriage occurred. Thank you for all the reply. And we will update everyone next time :) God bless.
