Hello,

My Uncle (LPR) wants to make a Petition for his Unmarried over 21 Son to the US.

But his Son has a Son (which is my uncle's grandson).

What is the procedure in this case?

Should the grandson be included in the I-130?

Or something else.

hi

yes, how old is his grandson? the petition will take over 7 years and his son must remained unmarried until he enters the US or your uncle must become a USC and then marry. the petition would take around 3 years more for a married child of a USC

you uncle start's by filing the i130

LPR petitioning unmarried son over age 21.

File I-130 for son. Wait 7 years for a visa. Grandson can come if his CSPA age is under 21.

Unless something really weird happens his grandson will have aged out.

It's unlikely that the grandson will be able to immigrate with his father.

It will take about 7 years for the visa. By then, the grandson will be 24. He will have aged out.

The only saving grace would be if it took 4 years to approve the I-130 which would reduce his age by 4 years for CSPA purposes. This is unlikely to happen, but it could.

The faster grandpa files the I-130, the better the grand son's chances of being an eligible derivative beneficiary.
