I want to apply for my father and I think I need an attorney if it's out of my scope of understanding.First he EWI back in 1987 stayed a couple years during this time he received his CA Driver’s license.

He came back again in 2000 EWI when his nephew passed away renewed his CA driver’s license but then left in August. He was only here a couple months and we are working on gathering proof of documents to show that this second time was not longer than the 180 days.

So if I understand this straight if he came and left the first time before April 1997 his first EWI basically doesn’t “count” there’s “no penalty”?

and then for the second time EWI it does count. But as long as he wasn’t here for more than 180 days he doesn’t get the 3 yr ban? And if we can’t find good enough proof for immigration to believe he lasted less than 180 days, does immigration just slap on a 3 yr ban?

He left 15 years ago so the bans of concern would be lifetime ones. And from what you say he does not have one
