how to cancel my I485 form

I'm married for 5 months now but my marriage is over.... I'm the petitioner and after my husband received his EAD card he started behaving differently as if he did not want to be with me anymore" He was just using me to get his green card ! I need an advised to cancel the I 485 asap! I do not want to continue this process

Call the USCIS local office and explain the circumstances. they will have you come in and file papers to remove your support from him. he will then be illegal, and forced to leave. especially if you ask them to come to your house when he's home and arrest him, then he will go to immigration lock up till he is deported......

You cannot withdraw the I-485 as it is your husband's application, not yours.

You can withdraw the I-130 and / or the I-864 you filed for him, as they are yours. Write a simple letter giving all of your information (name, address, phone number, husband's alien number, application numbers, etc.) and stating that you wish to withdraw your I-130 and I-864, and make an Infopass appointment at your local office. Hand deliver a copy of your letter at that Infopass appointment.

You should also send a second copy of the withdrawal letter to wherever those applications are currently pending.

Lol. On what planet will US immigration go to his house, arrest him, and hold him in lock up until he is deported? Stop making stuff up.

US immigration will do nothing. He is a low priority. He is not a high priority criminal.

If he chooses not to leave, he will continue to live and work here illegally like many other visa overstays. And no body is going to come after him. This is the truth.

I have one of the family relatives that fell into situation...basically a fraud marriage

with only intention on getting the Green Card.

It's a mess they are going through now...

But you are much early in the processing.

Hopefully you can withdraw the financial support and let him dangle out there,

and hopefully maybe even get deported.

Hang in there. There is another good man for you out there.

Write a letter to USCIS with your case number and information stating that you are withdrawing I-864, and mail to USCIS Lockbox that you mailed I-485, and then make an infopass appointment and provide them with the letter as well, stating that you are pulling the I-864.

Be informed that once his GC is issued, there is nothing that you can do.

File for divorce, and move on with your life.

There is no I-130 in this case.

AlcL, you need to let USCIS know that you are withdrawing your I-864. Do it by phone, do it by mail, and request INFOPASS to do it in person as well at your local USCIS. It is important that you do this BEFORE the 2 year GC is issued, or there will be nothing else you can do. If the marriage is over, I would recommend considering separating from your husband to avoid any further issues.

About USCIS showing up at your house and arresting him, that is not going to happen. From what I have read, to prove fraud against him will be tough unless you have thorough evidence of his intentions. Go ahead with stopping the I-864 before this gets more complicated.

1. impossible to get a number for a local office

2. they never ask for a human to come in

3. filing papers, well - it's a letter to withdraw the I-864, Affadavit of Support (so that's one right, sorta)

4. forced to leave? no. deportable if picked up at an immigration control point, but not forced to leave. Why? ICE has bigger issues that they are chasing after.

5. immigration lock up? only if he's caught at an immigration control point, or is arrested and a 'hold for ICE' order is in his electronic record.

OTOH, what you've written - man - I wish that was the proper path to withdraw an I-864. It's not, alas.

In the end, the OP will need to get the I-864 withdrawn now, nowish, for the adjustment of status process to stop. Once it's stopped, the foreign spouse has no further legal status in the USA, no path for anything leading to a green card.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
