Im in Italy and I left US less than 3 months ago...

I've called the Consulate and I must bring to them the divorce papers, they probably will give another paper to register at the state records.

After that I must apply to remove conditions.

There's a lot of wrong answers here about things that make people confused, if you believe or if you're guessing, please keep the answer to you.

I appreciate the ones that know what's right and wan't to help.

I don't think you understand it...

I know that I'm divorced.

In order to remove conditions without my ex wife I need to send to USCIS a divorce paper and I DON'T have it from US, only from another country.

Also according to US, I'm still married, there's no registry of divorce but in other hand it is wrong to write a fake paper.

Considering these situations, I don't want to do whats easier or take advantage of shortcuts. I just want to understand what's the right thing to do considering that both

options doesn't work due do my conditions.

You are the one that is not understanding the rules about marriages and divorces.

The US recognizes marriages and divorces from foreign countries.

Despite the fact that the US has no registry for divorce, your foreign divorce is valid in the US.

With your foreign divorce, you are considered divorced under US laws. You are NOT still married.

All the answers on here have been correct.

The only wrong answers are coming from you. You are wrong to think that despite your divorce abroad, you are still married in the US.

Read every post again and you will see that everyone gave you the correct answers.

Legally I'm not married but USCIS thinks that I am. Again if you don't understand the meaning of the question don't loose your time to answer.

USCIS doesn't monitor whether you're married or not, so they don't think anything - if you have divorced in US, they wouldn't know either. They don't really care. For some reason you keep insisting on this nonsense so good luck....

I know there are some countries that have specific procedures for overseas divorces, in that they basically don't recognize "quickie" divorces. I don't think the USA is one. I know someone (admittedly this was 40 years ago) who was married, went to the Dominican Republic for a weekend, came back divorced, and got married as soon as she returned. So unless USA law has changed, your Italian divorce is valid here. That might not be the case in Canada, but you're not in Canada.

What you need to do is file for removal of conditions with a divorce waiver. Enclose a copy of your Italian divorce decree. A certified translation wouldn't hurt. Since it is a waiver filing, you do not have to wait until 90 days before your conditional GC expires.

USCIS will almost surely grant you a one-year extension. Then you go through the process. You will have to prove your marriage was in good faith, and given the number of people posting here who seem to have totally legitimate marriages and yet get put through the wringer over evidence, I wouldn't assume a smooth ride just because you're marriage was in good faith. Hopefully it will go smoothly for you.

not one single person gave you any wrong answers. In fact you were the one who was wrong by thinking that a divorce from another country wouldn't be valid. If you don;t want answers, don't ask a question. I will never understand the need for some people to be rude.
