yea i am married but i hate it here..if i know before how hard it is to be without any family and any friends i wouldnt come here..not to mention different culture complitly.and if my husband know my language we would live there but he dosnt and i cant make enough for both of us and kids not to mention he have child support to pay so cant go anyway..but i will wait till i get my GC.. :( and how much is wait for that now?i was so in all of this before and now im complitly lost and dont know where exactly need to look for timeline..

Ok. I'm sorry to hear you are having a hard time after 2 years of living here...... Your Green card may take from a few months to a year, if you get interview waiver is slower that's why the possibility of the year....

But you know what when you file for AOS you apply for EAD and you are able to work or at least drive and maybe you can make some friends and socialize more, there can even be some people from your home country in your area and you will feel better :)

OP, you give us few answers for a complicated problem.

Where are you from, your home country? It would help to know who you were dealing with. You give us no dates, as arrival, file for AOS, because your time line is not filled out, which is your preference.

I would NOT travel without a GC, after an over stay that long. Not AP, but a GC!

You tell us nothing of your husband, your relationship, or just not much. Again, that is your preference.

Good Luck getting that GC so you can travel legally.

Per Matter of Arrabally and Yerrabelly, someone with a pending adjustment of status application and Advance Parole is not subject to the three and ten year INA 212 bars.

I also would not.

They may not be eligible for a bar, but it could still be a situation that ends up being more trouble than it's worth, which I see you agree.

I also agree that it would be best to wait for the green card and not travel on the AP. While it may be true that the 10 year ban wouldn't apply, it is still up to the discretion of the immigration officer at the POE to allow entry to the US if using AP. Definitely not a chance I would be willing to take.
