So i tried to find complete answer but i couldnt so i opened new topic.this is my story..I came her on K1 visa,get married in 90 days time frame but never filed for AOS because of money problems..Now im overstayed for 2 years and have 2 kids and i really want to go home and visit my family. Is it goin to be problem get my papers and working and travel visa since im overstayed for ao long time?I mean i should get working and traveling visa earlier then rest of papers?did anybody had similar situation or knows anything about that?do i need any extra papers or explanation why we didnt file for so long?

You can still file, but do not leave the US until your green card or AP is in your hands.

You should be ok with AP, personally if it was me I would wait for GC.

You can leave any time, getting back is the usual issue.

even if i get approved travel visa that u get in package with AOS papers?am i goin to have problems?

Traveling with an overstay might be a risk you don't want to take. AP does not guarantee entry with an overstay.

Per Matter of Arrabally and Yerrabelly, someone with a pending adjustment of status application and Advance Parole is not subject to the three and ten year INA 212 bars.

Agreed, it should not be a problem but I still would not do it unless I really had to.

Yes, but no one wants to debate about that in the immigration office. I too would wait for a green card.

You mention if it wasn't because of your kids you would go home. Are you still married to the person who filled for your k-1???? You need to be married to file for AOS, that comment made me mention that...

Once you have your green card or advance parole approved you can travel, I would personally wait for GC.
